The subject of the contract is the provision of services in the field of municipal waste collection from owners of inhabited properties, summer houses and other real estate used for recreation and leisure purposes, from the area of the Sułkowice Commune.
The subject matter of the contract is described in detail in the Description of the Subject of the Contract (OPZ), which is attached to this specification of terms and conditions;
The Contracting Authority does not require a site visit
1. The subject of the contract is the provision of services in the field of municipal waste collection from the owners of inhabited properties, summer houses and other real estate used for recreation and leisure purposes, from the area of the Sułkowice Commune.
2. In detail, the object of the order is described in the Order Item Description (OPZ), which is annexed to this specification of the terms of the contract;
3. The Contracting Authority requires the Contractor or Subcontractor to employ persons performing the following activities during the performance of the contract: driving waste collection vehicles and operators loading waste.
4. In the course of the performance of the contract, the Contracting Authority is entitled to perform control activities in relation to the Contractor's or Subcontractor's compliance with the requirement of employing persons performing the activities indicated in point 3 on the basis of an employment relationship.
In particular, the Contracting Authority is entitled to:
- request statements and documents to confirm compliance with the above-mentioned requirements and to assess them,
- request explanations in case of doubts regarding the confirmation of compliance with the above-mentioned requirements,
− carry out on-site inspections.
5. In the event of justified doubts as to the compliance with the labour law by the Contractor or Subcontractor, the Contracting Authority may request an inspection by the National Labour Inspectorate.
6. Definition of the contract according to the Common Procurement Vocabulary (CPV): 90513100-7 – household waste collection services; 90533000 – waste management services
7. Division of the contract into lots: The Contracting Authority does not divide the contract into lots, each of which would constitute a separate subject of the contract. The scope and subject matter of the contract does not restrict competition, and dividing the contract into lots would entail the coordination of the activities of the various contractors carrying out the various parts of the contract, which could seriously jeopardise the proper performance of the contract.
Supplementary contracts referred to in Article 214(1)(7): The Contracting Authority provides for the possibility of awarding, within 3 years from the date of awarding the basic contract to the existing service provider, a contract consisting in the repetition of similar services with a total value of up to 20% of the value of the basic contract. These orders include:
• collection of municipal waste from the owners of inhabited property, cottages and other properties used for recreational and leisure purposes, from the area of the Municipality of Sułkowice.
• The contract will be awarded after the procedure laid down for the contract from the free hand, preceded by the applicable invitation to negotiations and negotiations.
