The subject of the contract is the supply of electricity to 85 consumption points (hereinafter "PPE") with a total estimated volume (basic order) -119 465.38392 MWh. The contracting authorities specify the minimum consumption at 50% of the volume indicated above.

The above-mentioned forecast electricity consumption is indicative and may differ from the amount of energy actually consumed during the term of the contract. Reducing the amount of energy consumed does not entail any consequences for the ordering parties (recipients), except for the need to pay for the energy actually consumed according to the rates specified in the concluded Agreement. However, the amount of energy consumed under the Agreement shall not be less than 50% of the volume indicated in paragraph 1 (minimum scope of performance).

Electricity will be supplied in accordance with applicable law, in particular under the conditions set out in the Act of 10 April 1997 – Energy Law, executive regulations to this Act, in particular the Regulation of the Minister of Economy of 22 March 2023 on the detailed conditions for the operation of the power system, the Regulation of the Minister of Energy of 29 November 2022. on detailed rules for the formation and calculation of tariffs and settlements in electricity trading.

The execution of the subject of the contract will be based on the Model electricity sale agreement – Annex No. 3 to the SWZ, and the unit price for the purchase of 1 MWh of active electricity for a given delivery period will be determined on the basis of orders for the purchase of futures contracts by the Ordering Parties through the Polish Power Exchange S.A. in Warsaw.

This contract does not cover the provision of electricity distribution services
