1. The subject of the contract is the provision of winter maintenance services for poviat roads located in the Gdańsk Poviat in the winter season 2018/2019.

2. The scope of the subject of the contract:

The scope of the subject of the contract includes the provision of winter maintenance services for poviat roads located within the Gdańsk Poviat, to ensure the safety of road users along poviat roads belonging to the Road Administrator - the Poviat of Gdańsk.

The subject of the order was divided into 5 winter road maintenance circuits.

1. The scope of the subject of the contract includes the provision of winter maintenance services for poviat roads located within the Gdańsk Poviat, in order to ensure the safety of road users along poviat roads belonging to the Road Manager - Gdańsk Poviat

2. Task No. 1 - winter maintenance circuit No. 1 covering poviat roads with numbers: 2213G, 2224G, 2231G, 2232G, 2233G, 2235G, 2236G, 2237G, 2238G, 2239G, 2248G with a total length of snow removal 61.3 km, for spreading 22.4 km.

3. A detailed description of the winter road maintenance circuit can be found in the Specification of Essential Terms of the Contract.

4. In the event of heavy snowfall or snow slurries, which will result in no roadability, the Contractor shall use heavy equipment (rotor plow, grader, loader or bulldozer) with the help of which he restores the road's passability.

5. The Contractor shall ensure snow removal of road surfaces along their entire width and length, ensuring their passability.

6. In special cases, the Contractor will be required to snow removal with simultaneous spreading along the entire width and length of poviat roads.

7. The provision of winter road maintenance services must be provided 24 hours a day while ensuring continuous passage of poviat roads along their entire length and width. Services will be provided using: tractors or trucks, sandblasters or spreaders, light plows, medium or rotor plows, graders or bulldozers, heavy type loaders. The contractor will provide equipment and services as described above. The Purchaser reserves the right to control the equipment owned by the selected contractor (own / borrowed) throughout the entire period of performance of the subject of the contract.

8. The selected Contractor shall ensure, under this contract, a sand-salt mixture with 20% salt content in the sand. The contractor will be obliged to sprinkle with sand-salt mixture in the amount of 0.7 t / km of road. For the prevention and elimination of winter slipperiness, measures should be used in accordance with §2 of the Regulation of the Minister of the Environment of 27.10.2005 on the types and conditions of using measures that can be used on public roads as well as streets and squares (Journal of Laws No. 230, item 1960).

9. Contractors must ensure the provision of winter maintenance services for poviat roads located in the Gdańsk Poviat in the winter season 2018/2019, thus the cost of access to individual roads should be included in the price of the offer.

10. After completing the winter maintenance operation, the Contractor shall, within two weeks of calling the Employer, clear the roads of sand and other impurities and to remove excess sand.

11. Employer pursuant to art. 29 paragraph 3a of the Public Procurement Law requires employment by the Contractor or Subcontractor on the basis of an employment contract of employees performing activities directly related to driving vehicles and operating equipment necessary to perform the contract.

The above obligation also applies to subcontractors. Therefore, the contractor is obliged to include in each subcontract the relevant provisions obliging subcontractors to employ under the employment contract of all persons performing the abovementioned activities. Detailed rules for documenting employment based on the above-mentioned employment contract persons and the control of this obligation by the Employer and the penalties provided for in this respect are specified in the draft contract constituting Annex 5 to the ToR.

12. The contracting authority allows employment of a subcontractor / further subcontractors. A detailed record of the conditions of employment of subcontractors is set out in para. IX points 20 - 24 Additional information and model contract annex No. 5 to the ToR
