1. The subject of the contract is the provision of services to the Employer by Specialized Armed Protective Formations (SUFO) in the field of physical protection of persons and property and order in a protected area, in military complexes on economic supply of 42 School Aviation Base in 2020.
2. The subject of the contract is the provision of direct, permanent physical protection services with a firearm - pistol or revolver, long weapon - a rifle or machine pistol, military complexes supplied by the Military Economic Department 42 BLSz, in the following locations:
1) part I - Radom:
a) military complex in Radom ul. Sadków 9,
b) WKU military complex in Radom ul. 1905 30 and the Garrison Church in Radom pl. Constitution of May 3;
2) part II - Sochaczew / Grójec:
a) military complex in Sochaczew / Bielice,
b) military complex in Grójec / Ogrodzienice;
3) part III - Olszewnica / Borzęcin:
a) military complex in Olszewnica Stara - ul. Polish army,
b) military complex in Borzęcin Duży - ul. Spacerowa 75;
4) part IV - Nowe Miasto / Książenice:
a) military complex in Nowe Miasto nad Pilicą ul. Tomaszowska,
b) military complexes in the town of Książenice - ul. Al. Lipowa and Musały.
4. Security of facilities is to be carried out 24 hours a day in a 24-hour system on all days of the week, with security staff not allowed to perform it for more than 24 hours at a time, after which a break of at least 24h. In the complex in Sochaczew from Monday to Thursday 15.5 hours, and on Fridays 18 hours. However, in relation to the porter in WKU Radom on Monday for 10.5 hours, and from Tuesday to Friday for 9.5 hours and the porter in Olszewnica Stara 9 hours a day on business days, and for the porter in Sochaczew 12 hours on 24 hours a day on business days and will consist of:
1) protection of the area, objects, people, equipment, immovable and movable property within the protected military complexes;
2) handing over to the Police, Military Police or military order authorities of persons apprehended during the performance of protective tasks, in accordance with a specified procedure;
3) cooperation with the Military Police, military law enforcement agencies and the Police on the principles set out in separate regulations;
4) cooperation with the internal service of Military Units for which the service will be provided on the principles set out in the "Instruction for the Protection of the Complex / Military Unit", hereinafter referred to as the protection instruction;
5) perform the tasks specified by the Employer in accordance with the extract from the Military Unit security plan;
6) the arrival of the Intervention Group (Intervention Patrol) within a maximum of 10 min. from the time of notification and taking action in the event of a direct threat to the facility or persons staying in it;
7) providing additional protection related to achieving readiness to take action, as well as a signal about strengthening the system of protected facilities and after the announcement of mobilization, the imposition of martial law or during the war.
5. A detailed description of the subject of the contract is included in Annex 1 to the ToR and the contract, which the Employer will provide to the invited Contractors who meet the conditions set out in the announcement and this description.
6. The draft contract (Annex 3 to the ToR) is also a supplement to the description of the subject of the contract in the scope of provisions not regulated by the provisions in Annex 1 to the ToR.
7. Due to the specificity of the protective tasks performed (facilities subject to special protection, e.g. weapons and ammunition warehouses) and the priority of ensuring maximum security, the Employer does not agree to entrust the implementation of the contract or part of it to subcontractors (Article 36a (2) of the Act public procurement).
8. The Awarding Entity allows only Subcontracting in the scope of intervention group when it concerns: part IV - complex in Nowe Miasto n / Pilica and complexes in Książenice.
9. If the Contractor intends to entrust subcontracting in the field of the External Intervention Group, the provisions of Art. 36b, and art. 36ba of the Public Procurement Law.
10. According to the content of art. 36b paragraph 2 of the Public Procurement Law, the Employer informs that if the change or resignation from the Subcontractor concerns the entity on whose resources the Contractor relied, on the principles set out in art. 22a paragraph 1, in order to demonstrate compliance with the conditions for participation in the procedure, the Contractor shall be obliged to demonstrate to the Employer that the proposed other Subcontractor or Contractor independently fulfills them to a degree not less than the Subcontractor, whose resources the Contractor referred to during the contract award procedure.
11. According to art. 36ba paragraph 1 if the Subcontractor is entrusted with the performance of part of the service contract during its implementation, the Contractor, at the request of the Employer, presents the statement referred to in art. 25a section 1, or statements or documents confirming the absence of grounds for exclusion from this Subcontractor.
12. According to art. 36ba paragraph 2 if the Awarding Entity states that there are grounds for exclusion for a given Subcontractor, the Contractor shall be obliged to replace this Subcontractor or resign from entrusting the performance of part of the Subcontractor's contract.
13. The awarding entity requires pursuant to art. 29 paragraph 3a of the Act of 29.1.2004 Public Procurement Law / i.e. 2018 item 1986 with later change / that all activities of the subject of the contract be performed only by persons employed under an employment contract, if the performance of these activities involves the performance of work in the manner specified in art. 22 § 1 of the Act of 26.6.1974 Labor Code / i.e. from 2018 item 917 as amended / the Employer will require the Contractor to prove and document the fact that all activities performed by persons employed under a contract of employment.
14. The Awarding Entity allows conducting a site visit. The vision will take place according to the rules set out in the Terms of Reference, which the Employer will provide to Contractors invited to submit tenders.
15. Protection must be implemented by security employees with professional qualifications in accordance with the Act of 22.8.1997 on the protection of persons and property / i.e. from 2019 item 1495./.
16. The Contractor is obliged to ensure the protection of classified information obtained during the proceedings and after its completion, in the manner specified in the provisions of the Act on the Protection of Classified Information.
