The subject of the contract is "Purchase with delivery and unloading of medicines for the substitution treatment program to the Hospital Pharmacy Spec. Psych. ZOZ in Łódź." in accordance with the detailed description of the subject of the contract, constituting Annex No. 2 to the SWZ. Pharmaceutical products should meet the conditions for marketing admission and use in the Republic of Poland in accordance with the provisions in accordance with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2022, item 974, as amended) – if applicable, and the Act of 6 September 2001 Pharmaceutical Law (i.e. Journal of Laws of 2022, item 2301, as amended).
The subject of the contract is "Purchase and delivery and unloading of medicines for the substitution treatment program to the Hospital Pharmacy Spec.Psych.ZOZ in Łódź." in accordance with the detailed description of the subject of the contract, constituting Annex No. 2 to the SWZ. The subject of the contract delivered by the Contractor will be brand new, ready for use, free from physical and legal defects, originally packed, of the highest quality and will have at least 12 months validity period from the date of delivery, while the indication of the expiry date must be legible. In the case of a product whose expiry date given by the manufacturer is 12 months and less, it is allowed to deliver goods whose expiry date will be 2/3 of the expiry date granted by the manufacturer. The quantities of assortment specified by the Ordering Party, specified in the assortment and price form, which is the subject of this public procurement procedure, are amounts calculated in an estimated manner on the basis of the current needs of the Ordering Party and during the implementation of the contract in question may change up to 20% of the given quantities (reduced or increased) depending on the current needs of the Ordering Party.Pharmaceutical products should meet conditions for admission to trading and use in the Republic of Poland in accordance with the provisions in accordance with the Act of 7 April 2022 on medical devices (i.e. Journal of Laws of 2022, item 974, as amended) – if applicable, and the Act of 06 September 2001 Pharmaceutical Law (i.e. Journal of Laws of 2022, item 2301, as amended). The Ordering Party accepts 1 piece or 1 package as a unit of measurement. If the number of pieces in the package is not specified, the Ordering Party shall compare the price of the offer for one piece. The Contracting Authority allows for the possibility of submitting equivalent bids (the offered subject of the contract must meet all the requirements of the Contracting Authority with all parameters not worse than those specified in the SWZ, i.e. those that guarantee the maintenance of the same norms, parameters and standards), if the description of the subject of the contract shows that the subject of the contract has been determined by indicating trademarks, patents or origin, source or specific process, which characterizes products or supplies, services provided by a specific contractor, if this could lead to the privilege or elimination of certain contractors or products and to the extent indicated in Article 101 paragraph 4 of the PPL.The contractor is obliged to perform the contract on the terms and conditions described in the draft contract constituting Annex 3 to the SWZ. Deliveries will be carried out successively, each time on the basis of a detailed, written order submitted to the Contractor by phone, which will then be confirmed by the Ordering Party electronically or by fax. The delivery of the subject of the order includes the act of unloading and delivery of goods to the warehouse of the Ordering Party's hospital pharmacy in Łódź, ul. Aleksandrowska 159, on working days from Monday to Friday, except public holidays, between 8:00 and 13:30 together with the original and a copy of the invoice, subject to § 5 section 6 of the Agreement. The Contractor shall deliver each ordered batch of assortment by its own transport or courier at its own expense and risk. The delivery date of the ordered subject of the order will be determined on the basis of orders placed depending on the needs of the Ordering Party. The deadline for the completion of the order is determined up to a maximum of 5 working days from the placing of the order by the Ordering Party.In the event of a threat to the life of patients, the Ordering Party provides for deliveries to "CITO" (Urgent) within a maximum period of 24 hours, counted from the moment of placing the order by the Ordering Party confirmed by the Contractor. Acceptance of the order will take place after each confirmation of compliance with the order, quality and after signing by an authorized employee the specified invoice or delivery specification.
