The subject of this order is the purchase of electricity for the facilities indicated in Annex 1 to SWZ in accordance with the provisions of the Act of 10 April 1997. Energy law, Civil Code and implementing regulations issued pursuant to them.
Order — purchase of electricity for the facilities listed in Annex 1 to SWZ:
The estimated demand for electricity over a 12-month period is 1,277,918.00 kWh (a period of 12 months has been adopted for the purposes of the estimate)
The subject of this order is the purchase of electricity for the facilities indicated in Annex 1 to SWZ in accordance with the provisions of the Act of 10 April 1997. Energy law, Civil Code and implementing regulations issued pursuant to them.
The Municipality of Piaski and the units listed in Annex No 1 to the SWZ will conclude separate agreements arising from this procedure for the award of a public contract by means of an unlimited tender for the ELECTRIC ENERGY FOR THE FIRST GMINA AND ONE ORGANISATION. Details of the conclusion of contracts by the Municipality and its organisational units are included in Annex No 1 to the SWZ. It will be the responsibility of the Contractor to represent the Contracting Authority and its organizational units before the relevant Distribution System Operator in matters related to the notification of a change to the seller. For the performance of the abovementioned activities, the Contractor shall be granted an appropriate power of attorney (Annex 4.1 to SWZ)
The Contracting Authority shall act on his own behalf and on the basis of a signed agreement (agreement for inspection at the premises of the Contracting Authority), on behalf of:

• Nicolaus Copernicus Primary School in Sands
• School Team in Bystrzejowice First Helena Babisz
• Department of Municipal Services Sp. z o.o.
Order — purchase of electricity for the facilities listed in Annex 1 to SWZ:
The estimated demand for electricity over a 12-month period is 1,277,918.00 kWh (a period of 12 months was adopted for the purposes of the estimate).
The estimated value of the contract in the period of 12 months is PLN 1,006,099.22 (the period of 12 months was adopted for the purposes of estimation).
The performance of the activities arising from the power of attorney constituting part 1 of the Designed Agreement (part 4.1 of SWZ), in particular the Contractor obliges the Contractor to notify the designated Distribution System Operator to implement the sales contract concluded with the Contractor electricity, the submission of statements of will and the determination on behalf of the Contracting Authority of all necessary information in the field of termination of the existing contract for the sale of electricity and the provision of distribution services (comprehensive agreement), representation of the Contracting Authority before the competent Operator of the Distribution System in matters related to the conclusion of a distribution service contract.
The Ordering Party informs that the process of changing the seller takes place once again. Distribution agreements for all collection points are concluded for an indefinite period. All customers are entitled to benefit from the maximum price of electricity within the meaning of Article 2(1) of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023. The Customers will attach to the contracts concluded as a result of this proceeding the STATEMENT OF THE AUTHORIZED RECIPIENT referred to in Article 2(2)(b) to (e) of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws, item 2243). The Ordering Party reserves the right to change the purpose and affiliation of electricity consumption points to a specific customer and thus the possibility of changing the % share of consumption, which will be covered by tariff protection.
