1. The subject of the contract is Comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services.
2. The Contracting Authority shall divide the order into two parts.
• Part 1 - 270 electricity consumption points located in ENERGA Operator SA area. For a list of energy consumption points forming part of this part, see Annex No 3.1 to SWZ
• Part 2 - 16 electricity consumption points located in ENEA Operator Sp. z o.o. A list of energy consumption points included in this part is set out in Annex No 3.2 to SWZ

Part 1 - 270 electricity consumption points located in ENERGA Operator SA1.The subject of the order is a comprehensive supply of electricity, including the sale of electricity and the provision of electricity distribution services.
2.The Contracting Authority shall split the order into two parts.

3.A detailed description of the item of the order for parts 1 and 2 is specified in:

•Detailed description of the object of the contract as Annex 1 to SWZ for Part 1 of the order and Part 2 of the order.

4.The law applicable to this contract (including the contract concluded as a result of this proceeding and for the assessment of the legal effects of all documents in that contract) is Polish law, taking into account European Union law.
5.The Contracting Authority shall not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Pzp Act.
6.Subcontracting:
1) The Contractor may entrust the execution of part of the contract to the subcontractor (subcontractor).
2) In connection with the execution of the contract, the contracting authority does not reserve the obligation to personally perform the key tasks of the contract.
3) The Contracting Authority requires that, if part of the contract is entrusted to subcontractors, the Contractor shall indicate in the offer the parts of the contract whose execution he intends to entrust to the subcontractors and provide (if they are already known) the names of those subcontractors.
4) Entrusting part of the contract for execution to subcontractors does not exempt the contractor from responsibility for the proper performance of the contract.
7.The Contracting Authority does not provide for the obligation of the contractor to carry out the local vision and to verify the documents necessary for the execution of the contract available on the spot with the Contracting Authority.
- does not allow for the submission of a variant tender referred to in Article 92 of the Pzp Act, i.e. an offer providing for a different manner of performance of the contract than those specified in this SWZ.
- does not provide for the conclusion of a framework agreement and the establishment of a dynamic purchasing system and does not provide for the selection of the most favourable offer by electronic auction.
- does not provide for the award of contracts under Article 214 (1) (8) of the Law Pzp.
- does not permit the submission of tenders in the form of electronic catalogues or the attachment of electronic catalogues to the tender, in the situations laid down in Article 93 of the Pzp Act
- does not provide for settlement in foreign currencies. The settlement of the order is made in PLN.
- does not provide for reimbursement of participation in the proceedings
- does not provide for the granting of advances for the performance of the contract.
15.The proceedings will be conducted in Polish.
16.In addition to the possibility of annulling the procurement procedure under Article 255 of the Pzp Act, the contracting authority provides for the possibility of annulment of the procedure if the public funds which he intended to allocate to finance all or part of the contract have not been granted to him.
17.The contract has been divided into 2 parts (Part 1, Part 2), the Contracting Authority permits the possibility of submitting partial tenders, i.e. the Contractor may submit a tender for any number of parts.
18.The Contracting Authority requires that the subject of the contract be executed in accordance with the requirements in the Detailed Description of the Object of the Order (SOPZ) (part 1 of the SWZ) and in accordance with the “Designed Contract Terms” (part 2.1 of the SWZ for Part 1 and Annex 2.2 to SWZ for Part 2 orders)
