1. The subject of the contract – under the basic contract – is the supply of electricity in the period from 01.01.2024 to 31.12.2024 up to 523 consumption points (PPE) with a total estimated volume of 6 559.28 MWh, of which:
1) For premises and facilities (Part 1 of the contract) 5 410.98 MWh – a detailed list of PPE is attached as Annex 1a to the SWZ,
2) For the needs of road lighting (Lot 2 of the contract) 1 148.30 MWh – a detailed list of PPE is provided in Annex 1b to the SWZ.
2. The forecast electricity consumption indicated above is indicative and may differ from the amount of energy actually consumed during the term of the contract. The amount of electricity was estimated on the basis of historical data on electricity consumption in the last 12 months and taking into account the actions taken by the contracting authorities referred to in Article 37 of the Act of 7 October 2022 on special solutions for the protection of electricity consumers in 2023.
Supply of electricity to premises and facilities1. Number of metering systems accounting for consumed electricity 365 pcs.
2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.
3. Estimated electricity consumption during the term of the contract 5 410,98 MWh. Consumption data are indicative.
4. Deliveries will take place from 01.01.2024 to 31.12.2024, details of delivery dates in relation to individual collection points are described in Annex 1a to the SWZ column "Delivery period".
5. Current electricity supply contracts will expire or terminate with effect from the day preceding the planned delivery start date (column 'Delivery period'). The obligation to terminate the contracts lies with the contracting authorities (recipients).
6. The Contracting Authority Regional Municipal Waste Utilization Plant "Rypin" Sp. z o.o. has the status of a Producer. The ordering party has two RES sources: biogas and PV panels. The amount of energy produced in RES and intended for resale during the term of the contract is approx. 3 MWh. The contracting authority will accede to the contract for balancing and resale of energy according to the template used by the contractor – details in Annex 1a to the SWZ.
7. The subject of the contract shall be the supply of electricity with quality standards specified in accordance with applicable regulations.
8. Electricity quality standards are described in the EP Act and in the Regulation of the Minister of Climate and Environment of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 819). The rules for shaping and calculating tariffs and settlements in electricity trade are set out in the Regulation of the Minister of Climate and Environment of 29 November 2022 (Journal of Laws of 2022, item 2505 with późń.zm.).
9. CPV code under which the subject of the contract is classified: 09300000-2 - Electricity, heat, solar and nuclear, 09310000-5 - Electricity.
10. The Contractor, based on the Power of Attorney granted, will be obliged to report on behalf of itself and the contracting authority (recipients) the contract to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
11. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then subjective qualification of the contractor whose bid was rated the highest, in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure
12. As a result of the outcome of the public procurement procedure, 14 contracts will be concluded.
13. The Ordering Party does not require the provision of a performance bond.
The Ordering Party demands a deposit in the amount of - Part 1 of the contract: PLN 90,000.00.
Supply of electricity for the needs of road lighting1. Number of metering systems accounting for consumed electricity 158 pcs.

9. The Contractor, based on the Power of Attorney granted, will be obliged to report the contract on its own behalf and the contracting authority(s) to the relevant DSO in accordance with applicable regulations and to represent it before the DSO in the process of changing the seller.
10. The contracting authority reserves the right to use Article 139(1) of the PPL, i.e. the possibility of first examining and evaluating bids, and then selecting the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure
11. As a result of the settlement of the procurement procedure, 7 contracts will be concluded.
12. The Contracting Authority does not require the provision of security of due performance of the contract.
13. The Ordering Party demands payment of a security in the amount of - Part 2 of the contract: PLN 15,000.00.
