The subject of the contract is the preparation of design documentation for the reconstruction of the S/C gas network in Bystra, Gorlice commune – stage 2. The project should be developed according to the Technical Conditions No.: PSGKR. ZMSZ.763.1109317.1.22 of 13.07.2022, issued by Polska Spółka Gazownictwa Sp. z o.o., Gas Plant Branch in Krakow.

1. The Contracting Authority entrusts and the Contractor undertakes to perform a construction and executive design for the reconstruction of the S/C gas network in Bystra, Gorlice commune – stage 2 and exercise author's supervision, which will be jointly the subject of the Agreement (Subject of the Agreement).

2. The Contractor is obliged to read the "General Terms and Conditions of Contracts Executed for Polska Spółka Gazownictwa sp. z o.o." of 28.03.2022. (GTC), available on the Ordering Party's website at www.psgaz.pl, in the tab: For the contractor / Downloads. The Contractor declares that he has read the GTC before concluding the Agreement, does not raise any objections to them and accepts them in full. The Parties confirm that the GTC constitute an integral part of the Agreement. In the event of discrepancies between the provisions of the Agreement and the GTC or other annexes, the provisions of the Agreement shall prevail, subject to § 12 of the GTC.

3. The subject of the Agreement includes in particular:

1) execution of the construction and executive design and bill of quantities:

a) reconstruction of the existing S/C gas network into PE 100 RC SDR 17.6, PE 100 RC SDR 11 dn 160, dn 90, dn 25 with a total length of 9700 m in Bystra, Gorlice commune – stage 2,

hereinafter referred to as the Project

2) obtaining all required opinions, permits and decisions, including obtaining on behalf of and for the Employer, from the competent authority, the final building permit decision or notification on behalf of and for the Employer the intention to start construction works or construction not requiring permission for building,

3) execution of investor cost estimates,

4) exercising author's supervision.

4. A detailed description of the Subject of the Agreement and the Contractor's obligations is included in the Description of the Subject of the Order (OPZ) constituting Annex No. 1 to the Agreement and Technical Conditions No. PSGKR. ZMSZ.763.1109317.1.22 of 13.07.2022r. constituting Annex 2 to the Agreement.
