1. The subject of the contract is -Name of the procedure: Delivery of license updates and subscriptions for software (Products) and Associated Services, in accordance with the provisions of perpetual framework agreements: Microsoft Business and Services MBA/MBSA U9100053, Microsoft Product and Services Agreement No. 4100013999 (MPSA) and Microsoft Enterprise Master Agreement No. 80E60204 (EA), concluded by the Ministry of Digital Affairs with Microsoft for PFRON.
2. The offered products must have descriptions of fields of exploitation specified by the Manufacturer within the scope of the offered license program.
3. The Contracting Authority shall allow the Contractor to offer Products and Services equivalent to
to those set out in this TOC. In the event that the Contractor offers equivalent Products or Services, it is obliged to demonstrate their equivalence in relation to the subject matter of the contract described in Appendices 1 and 6 to the Terms of Reference.

1. The subject of the contract is the delivery of updates of licenses and subscriptions to software (Products) and Associated Services, in accordance with the terms and conditions of perpetual framework agreements: MBSA, MPSA and EA, carried out throughout the term of the Agreement by an entity with the status of a Licensing Solution Provider (LSP). If equivalent solutions are offered, the subject of the contract should be performed throughout the entire period of performance of the Agreement by an entity authorized by the manufacturer to sell equivalent solutions.
2. The Ordering Party requires that the offered products from the Manufacturer comply with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of personal data (GDPR).
3. The offered products must have descriptions of fields of exploitation specified by the Manufacturer within the scope of the offered license program.
4. The Contracting Authority allows the Contractor to offer Products and Services equivalent to those specified in this Terms of Reference. In the event that the Contractor offers equivalent Products or Services, it is obliged to demonstrate their equivalence in relation to the subject matter of the contract described in Appendices 1 and 6 to the Terms of Reference.
5. The Contracting Authority requires the Contractor to have the status of a Licensing Solution Provider (LSP) active on the Polish market (except for equivalent solutions).
