1. The subject of the procurement procedure is the supply of electricity to the indicated facilities of the Ordering Party, in accordance with the provisions of the Act of 10 April 1997 – Energy Law (Journal of Laws of 2022, item 1385)

1.1. The Ordering Party in these proceedings acts on its own behalf.

1.2. Otwockie Przedsiębiorstwo Wodociągów i Kanalizacji Sp. z o.o. will conclude the contract on its own behalf and will be both the buyer and the payer/recipient.

1.3. The estimated demand for electricity in the period: 6 months from the date of signing the contract is 2,016.078 MWh. The given amount of electricity does not constitute the Ordering Party's obligation to purchase electricity of this size. The settlement of the delivery will take place on the basis of the actual energy consumption at the price resulting from the submitted offer.

1.4. The condition for the commencement of electricity supplies within the indicated period is the positive implementation of the procedure of changing the seller, and the Contractor having a valid contract for the provision of electricity distribution services. (GUD)

1.5. The Ordering Party shall grant the Contractor selected in the proceedings a power of attorney to submit a sales contract on behalf of the Ordering Party to the Distribution System Operator (DSO) in order to implement the concluded contract for the sale of electricity and represent the Ordering Party in the process of changing the seller. Carrying out the procedure of changing the seller is the responsibility of the Contractor.
