The subject of the order is the following services:

Receiving, transportation and management of municipal waste immediately from the property on which residents live and do not reside, including substituting, collection, transportation and management of municipal waste collected in the container as part of additional services and delivery and replacement of waste containers.

The subject of the contract are services including the collection, transportation and management of municipal waste immediately from the property on which residents reside and do not reside, including substituting, collection, transportation and management of municipal waste collected in a container in as part of additional services and substitution of waste containers.

The subject of the contract should be performed in accordance with the provisions of the SWZ, the model contract, the principles of technical knowledge and due diligence, as well as the applicable regulations and required permits and according to the instructions of the Ordering Party, persons and equipment at the disposal of the Contractor taking into account the minimum requirements specified in the Regulation of the Minister of Environment of 11 January 2013 on detailed requirements for receiving municipal waste from property owners (Journal of Laws of 2013 item 122).

Pursuant to Article 95 (1) of the Pzp Act, the Contracting Authority requires employment on the basis of an employment contract by the Contractor or the Subcontractor during the execution of the subject of the contract of persons performing activities consisting in receiving and transporting municipal waste, i.e. drivers of vehicles with whom the transport of waste and persons engaged in loading waste is carried out, if the performance of these activities consists in carrying out work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 — Labour Code.

The Purchaser does not allow the submission of a variant offer.

The Contracting Authority shall not allow submission of partial tenders within the framework of the contract in question. In the Contracting Authority's assessment, the lack of division of the contract into parts does not limit on the quantitative and qualitative level the possibility of participation of contractors of Small and Medium Enterprises. In addition, waste collection and management are related services. The conduct of separate procedures for the collection and management of waste does not guarantee a reduction in the total costs of the above proceedings, since the potential contractor concluding multi-year contracts with waste management installations has a greater opportunity to negotiate more favorable price than the municipality individually. Furthermore, it should be emphasized that Bojszowy Municipality does not have its own waste treatment plant, which could be entrusted with the management of municipal waste. Therefore, it is reasonable for a potential contractor to take care of waste collection and its management covering the area of the whole municipality.
