Description:
"Transport of disabled children, pupils and youth to schools in the period from 01.09.2023. until 31.08.2024."

The subject of the contract includes in particular:

Transport service related to the implementation of the obligation specified in Article 32 paragraph 6 and Article 39 paragraph 4 of the Act of 14 December 2016. Law on School Education (i.e. Journal of Laws of 2020, item 910 with późn.zm), consisting in transporting disabled children, i.e. (pupils, pupils and youth), residing in Warsaw in the Włochy District m.st Warsaw. The service will include transport on the home-school-home route along with providing children (pupils, pupils and youth) with care during transport on all days of school or rehabilitation-and-education classes, in accordance with the calendar of the school year 2023/24 and the "Summer and Winter in the City" campaign. The service will cover 31 disabled children, i.e. (pupils, pupils and youth), attending kindergartens, primary and secondary schools, including special schools and educational centers, in accordance with Annex 1 to the agreement (Annex 12 to the SWZ)

3.2. Requirements related to the performance of the contract regarding the employment by the Contractor or Subcontractor of persons on the basis of an employment relationship:

a) The contracting authority applies the Social Clause in the proceedings in question pursuant to Article 95(1) of the Act of 11 September 2019. Public procurement law

(Journal of Laws of 2019, item 2019, as amended);

b) The Contractor is obliged to employ persons to perform the driver's activities on the basis of an employment contract

and a caregiver consisting of:

• for drivers: driving up to the place of residence of the students and in accordance with

with a schedule of their distribution to educational institutions and after the end of the lesson, collection from educational institutions and taking them to the house (building);

• for caregivers:

picking up children from their parents (guardians) from the house (building) and after taking them to school for classes, helping children undress

in the cloakroom, and then handing over the students to the care of the teacher,

in one particularly justified case, the guardian will be obliged to pick up the child from the apartment and help deliver it to the vehicle;

after the end of classes, collection of children from teachers at school and, if necessary, help children in dressing in the cloakroom and after transport to the house (building), transfer to the care of parents or guardians, in one particularly justified case, the guardian will be obliged to deliver the child to the apartment,

assistance in getting in and out of the vehicle, if necessary transferring the child from the wheelchair to the vehicle, ensuring that children are secured with belts or transported during transport

in car seats (provided by parents or legal guardians),

c) Other provisions related to social clauses, including the method of verifying the employment of persons and the rights of the Contracting Authority in the scope of control of compliance by the Contractor with the requirements related to the employment of these persons and sanctions for failure to meet these requirements, are specified in § 5 and § 10 section 2 point 6) of the Draft provisions of the contract.

3.3. The Ordering Party plans to perform not less than 50% of the number of services specified in the Price Form.

3.4. A detailed description, manner of performance and scope of services are specified in the following documents:

3.4.1. Draft provisions of the agreement (hereinafter also referred to as "PPU") constituting Annex 3 to the SWZ,

3.4.2. Offer form,

3.4.3. Price Form.

3.5. During the performance of the contract, the Contractor shall be obliged to fulfill the obligations arising from

from the Act of 11 January 2018 on electromobility and alternative fuels regarding the participation of electric vehicles or vehicles powered by natural gas as part of the performance of public tasks commissioned by a local government unit. Pursuant to Article 68(3) of the aforementioned Act, the total share of electric vehicles or vehicles powered by natural gas in the fleet of motor vehicles used in the performance of this task is to be at least 10%.
