1. The indication of electricity consumption in the list of facilities (Appendices No. 1, 2, 3 to the SWZ) and the electricity consumption accepted into the contract is only indicative, serving only to calculate the estimated value of the contract and compare offers. It does not constitute an obligation for the Ordering Party to purchase electricity in the given quantity.
2. Settlement of liabilities arising from the sale of electricity will be carried out according to the indications of metering and settlement systems. The sale of electricity will take place under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (Journal of Laws of 2022, item 1385, as amended) implementing regulations to this Act, in particular the Regulation of the Minister of Economy of 22 March 2023 on the detailed conditions for the operation of the power system (Journal of Laws of 2023, item 632), the Regulation of the Minister of Climate and Environment of 29 November 2022 on the detailed rules for shaping and calculating tariffs and settlements in electricity trading (Journal of Laws, item 2505 and item 632). 226 of 2023 from late. as amended), with the rules set out in the concessions, the provisions of the SWZ and the price of electricity presented in the offer and with the prices of distribution parameters in accordance with the current tariffs of the distribution network operator, approved by the President of the Energy Regulatory Office with which the Contractor has concluded a contract for the provision of distribution services.
3. The settlement period shall be two months. Settlements for the distribution of electricity will take place on the basis of current indications of metering and settlement systems according to the rates of fees resulting from the submitted offer and the Distribution System Operator's Tariff, the Seller's Tariff.
4. When submitting a bid, the Contractor must have concluded a contract for the provision of electricity distribution services with the distribution system operator operating on the territory of the Contracting entity or a statement that it has an agreement with the Distribution System Operator enabling the provision of electricity distribution services to the Ordering Party's facilities or a statement on ensuring the conclusion of such an agreement. The quality standards referred to in Article 246(2) of the Public Procurement Law are set out in the Energy Law and in executive acts and Polish standards.
5. The Contracting Authority shall grant the Contractor a power of attorney to terminate the existing contracts for the sale and distribution of electricity within the framework of applicable regulations and to the extent mutually agreed by the Contracting entity and the Contractor.
