Medical equipment of the Long-Term Care Center in the subregion at SZGiChP in Koszalin as part of the project No. RPZP.09.01.00-32-0002/18 – purchase of medical equipment, apparatus and assortment

1. The subject of the contract is medical equipment for the Long-Term Care Centre in the subregion at the Specialist Team of Tuberculosis and Lung Diseases in Koszalin as part of the project No. RPZP.09.01.00-32-0002/18 – purchase of medical equipment, apparatus and assortment within the scope specified in the Terms of Reference.

1. The subject of the contract is medical equipment for the Long-Term Care Centre in the subregion at the Specialist Team of Tuberculosis and Lung Diseases in Koszalin

as part of the project no. RPZP.09.01.00-32-0002/18 – purchase of medical equipment, apparatus and assortment within the scope specified in the Terms of Reference.

2. The Ordering Party does not divide the order into parts. Thus, the contracting agent shall not permit the submission of partial tenders referred to in Article 7 (15) of the Pzp Act.

3. The order is for the purchase of equipment of the same type. The purchase of all the equipment that is the subject of the order from one Contractor allows you to obtain a lower price. Failure to divide the contract will not distort competition by restricting the possibility of smaller operators, in particular small and medium-sized enterprises, to bid for the contract.

In addition, dividing the subject matter of the contract into parts and coordinating the activities of different Contractors performing individual parts of the contract closely related to each other could jeopardize the proper performance of the contract and cause difficulties in enforcing repairs during the warranty period and warranty from different Contractors

4. A detailed description of the subject of the contract and technical requirements is included in Appendix No. 3 to the Terms of Reference, i.e. the assortment and price form specifying the quantity and technical requirements of the subject of the contract. In cases where the description of the subject matter of the contract indicates standards, trademarks, patents or the origin, sources or a specific process that characterizes the products supplied by a particular Contractor, it means that the Contracting Authority cannot describe the subject matter of the contract in a sufficiently precise way

and comprehensible way. In such situations, any references to standards, trademarks, patents, origin, source or particular process shall be read with the words "or equivalent". If the Ordering Party has indicated brands or trade names, it specifies the class of the product being the subject of the order and serves to establish the standard, and does not indicate a specific product or manufacturer. The Contracting Authority shall indicate the criteria used to assess equivalence: the Contracting Authority shall consider equivalent equipment to be products that meet the minimum quality, performance and technical requirements corresponding to the requirements indicated by the Ordering Party in the assortment and price form. This means that an equivalent product must have parameters not worse than those indicated by the Ordering Party, i.e. at least at the level required by the Ordering Party in the assortment and price form.

5. The Contractor guarantees that the delivered subject of the contract is brand new, complete, free from any physical and legal defects.

6. The minimum required warranty period for the subject of the order is 12 months. The Contractor is obliged to deliver the subject of the contract to the Contracting Authority's registered office at its own expense and risk. In addition, the Contractor is obliged, at its own expense, to conduct implementation training on the subject of the contract, to provide instruction and to train employees in the principles of using the equipment provided.
