1. The subject of the contract is the service of comprehensive property and liability insurance of the Municipality of Olsztyn defined — according to CPV codes:
(a) 66.51.00.00-8 — insurance services;
(b) 66.51.51.00-3 — property insurance against all risks;
(c) 66.51.54.00-7 — property insurance against the effects of the elements;
(d) 66.51.50.00-3 — damage or loss insurance services (theft and glass);
(e) 66.51.52.00-3 — insurance of electronic equipment against all risks;
(f) 66.51.64.00-4 — general liability insurance;
(g) 66.51.21.00-3 — insurance against the consequences of unfortunate accidents;
(h) 66.51.20.00-2 — insurance of medical costs abroad.

3. The Contracting Authority shall inform that it shall apply the procedure referred to in Article 139 of the Pzp Act. In the first instance, the Contracting Authority shall examine and evaluate the tenders and then make the subject qualification of the Contractor, whose tender will be the highest assessed, in the absence of grounds for exclusion and fulfilment of the conditions for participation in the proceedings.
4. The Contracting Authority does not require the submission with the offer of the declaration referred to in Article 125 (1) of the Pzp Act, i.e. the Single European Procurement Document. The Contracting Authority shall only request this declaration from the Contractor whose offer shall be assessed at the highest.
5. The Contracting Authority does not provide for the award of the contracts referred to in Article 214 (1) (7) of the Law Pzp.
4. The Contracting Authority provides for the use of the right of option referred to in Article 34 (5) of the Law Pzp.

The Contracting Authority informs that, using the disposal of Article 18 (4) in conjunction with Article 96 (1) and Article 133 (3) of the Law, Pzp shall specify confidential information in the SWZ. The description of the object of the order together with the attachments (Annexes 3 to 9.2 to SWZ) will be made available to those Contractors who directly request the release of confidential information (Annex 12 to SWZ). Information for risk assessment contains a lot of sensitive information as the values of insured property in a given location, security (alarms, surveillance, etc.), liability limits in theft risks, an accurate description of liability protection. The Contractor (insurer), on the basis of an application posted on the website of the proceedings, will receive a set of attachments to the SWZ in order to prepare the offer in accordance with the principle of representation of the power of attorney to act on his behalf.
6. In accordance with Article 138, paragraph 2 (2) of the Law Pzp of 11 September 2019 and the urgent need to award the contract due to ensuring the continuity of insurance coverage and the conclusion of a new insurance contract before 1 September 2021. The Contracting Authority shall set a deadline for submission of tenders not less than 15 days.
7. The Contractor shall, prior to signing the contract, be obliged to provide a security for the due performance of the contract for an amount representing 5% of the total /bruto/ price indicated in the tender.
