6.3. Before awarding the contract, the Contracting Authority shall call the highest rated contractor to submit within the specified time limit, not less than 10 days, current as of the date of submission of the following statements or documents:
6.3.1 List of statements or documents made by the Contractor in the proceedings at the request of the contracting party in order to confirm the absence of grounds for exclusion:
(a) current at the date of submission of the Statement in the form of a Single European Procurement Document drawn up in accordance with the model standard form set out in Commission Implementing Regulation (EU) 2016/7 of 5 January 2016/7 of 5 January 2016 /OJ. EU No L 3 of 6.1.2016, p. 16/, /Annex 3 to SWZ/
NOTE: Part IV ONE: The qualification criteria of the contractor are completed only by Part α.
(b) the write-down or information from the National Court Register or from the Central Register and Information on Economic Activities drawn up not earlier than 3 months before its submission, if separate provisions require entry in the register or records, in order to confirm the absence of grounds for exclusion pursuant to Article 109 (1) (4) of the Pzp Act;
(c) if the Contractor is established or domiciled outside the territory of the Republic of Poland, instead of the documents referred to in:
1) b — files a document or documents issued in the country where the contractor is established or domiciled, confirming that no liquidation has been opened or declared bankrupt.
2. The documents referred to in point 1) should be issued no earlier than 3 months before their submission.
3. If, in the country where the contractor is established or domiciled, the documents referred to in point 1 are not issued, they shall be replaced, respectively, in whole or in part, by a document containing the statement of the contractor accordingly, indicating the person or persons entitled to his or her representation, or declaration of the person to whom the document was intended to concern, taken under oath, or, if in the country where the contractor is established or domiciled, there are no provisions of a declaration under oath, made before a judicial or administrative authority, a notary, a body of self-government professional or economic, competent by virtue of the seat or place of residence of the contractor.
(d) In the case of joint application by the contractors for the award of a contract, the contracting authority shall examine whether there is no basis for exclusion against each of those contractors, the documents in point (a) (b) shall be submitted by each of the contractors jointly.

6.4. Rules for participation in the proceedings of Contractors jointly applying for the award of the contract.
6.4.1. Contractors applying jointly for the award of a contract shall be required to establish a proxy to represent them in proceedings or to represent them in proceedings and conclude a public procurement agreement. The written power of attorney should be attached to the offer.
6.4.2. Contractors jointly applying for the award of the contract shall be jointly responsible for the execution of the contract.
6.4.3. The Contracting Authority reserves the right to request from the Contractors submitting a common offer to the Contracting Authority to submit a contract to the Contracting Authority a contract defining their relationship.
6.4.4. By Contractors jointly applying for the award of the contract, the Ordering Party also means Contractors who are partners of a civil partnership.

6.5. To the extent not regulated by the SWZ, the provisions of the Regulation of the Minister of Development of 30 December 2020 on subjective evidence measures and other documents or statements that the contracting authority may request from the contractor in the procurement proceedings /Journal of Laws of 2020 shall apply. item 2415/
6.6. The Contractor shall not be obliged to make statements or documents proving the absence of grounds for exclusion if the contracting authority has statements or documents relating to that contractor or may obtain them through free and public databases, in particular public records within the meaning of the Act of 17 February 2005 on the informatisation of the activities of entities carrying out public tasks /t.j. of Laws of 2021, item 670/. To this end, the Contractor is obliged to indicate in the bid submitted explicitly and exhaustively the source (address) of the database or the procedure in which the relevant statements or documents are located at the Contracting Authority.
If the Contractor does not provide in the submitted offer the source (address) of the database or proceedings relating to the writedown or information from the National Court Register or from the Central Registry and Business Information, the Contracting Authority to confirm the absence of grounds for exclusion from the proceedings will benefit from documents found in generally available databases.
6.7. If the contractor fails to submit the statements and documents referred to in paragraph 6.3.1. of this SWZ, the statements or documents are incomplete, contain errors, the Contracting Authority shall call for them to be submitted, supplemented, corrected within the time limit indicated by themselves, unless, despite their submission, the Contractor's offer would be rejected regardless of filing, supplementation or correction or there will be conditions for annulling the proceedings.

5. CONDITIONS OF PARTICIPATION IN THE PROCEEDINGS
Contractors who can apply for the contract:
5.1. are not subject to exclusion under Article 108 (1) of the Pzp Act. ;
5.2. The Contracting Authority provides for the exclusion of the contractor pursuant to Article 109 (1) point 4 of the Pzp Act: in respect of which liquidation has been opened, bankruptcy declared, whose assets are managed by a liquidator or court, has concluded an arrangement with creditors whose economic activities are suspended or is located in another such situation arising from a similar procedure provided for in the rules of the place of initiation of that procedure.
5.3. In the case of joint application by the contractors for the award of a contract, the contracting authority shall examine whether there is no basis for exclusion against each of these contractors.
5.4. The contracting authority in an unlimited invitation to tender pursuant to Article 139 of the Pzp Act will first examine and evaluate tenders, and then examine whether the contractor whose offer has been assessed as the most favourable is not subject to exclusion and fulfils the conditions of participation in proceeding.
