The subject of the contract is the provision of services in the field of reception, transport and treatment of medical waste.
1. A detailed description of the subject of the contract as well as the method of implementation and payment deadlines are specified in the draft contract, which constitutes Annex 3 to the SWZ.
2. The Contracting Authority requires that the provision of services being the subject of the contract be carried out in accordance with applicable law in the Republic of Poland, in particular with:
(a) the Law of 27 April 2001. Environmental Protection Law (Journal of Laws of 2022, item 2556, as amended);
b) the Act of 14 December 2012 on waste (Journal of Laws of 2022, item 699, as amended);
c) the Regulation of the Minister of Health of 5 October 2017 on the detailed method of dealing with medical waste (Journal of Laws of 2017, item 1975);
d) the Regulation of the Minister of the Environment of 13 January 2014 on the document confirming the disposal of infectious medical waste or infectious veterinary waste (Journal of Laws of 2014, item 107);
e) the Act of 19 August 2011 on the transport of dangerous goods (Journal of Laws of 2022, item 2147, as amended).
3. The Contractor's offer must comply with Article 20(3)(2) and (4)-(6) of the Waste Act of 14 December 2012 (i.e. Journal of Laws of 2022, item 699, as amended).
4. The Contracting Authority reserves that in case of any doubts raised in relation to the statements submitted in the offer, it may request relevant information from the Provincial Inspector for Environmental Protection competent for the place of location of the disposal plant.
