The subject of the contract is the successive delivery of diesel fuel for the needs of ZGO AQUARIUM Sp. z o.o. in the period from 01.01.2023 to 31.12.2023 in the amount of about 160,000 liters, with the right to increase deliveries to the amount of 200,000 liters according to the needs of the Ordering Party.
The fuel will be delivered successively, in accordance with the Ordering Party's own needs, in batches of approx. 5,000.00l – 10,000.00l. Diesel fuel will be stored in three above-ground fuel storage tanks with a capacity of:
- 1 tank - 2.500,00 liters,
- 2 tanks – 5,000.00 liters each.
The expected consumption of diesel fuel per week is 3.5-4 thousand l.

The fuel will be delivered successively, in accordance with the Ordering Party's own needs, in batches of approx. 5,000.00l – 10,000.00l. The oil will be collected in 3 above-ground fuel storage tanks with a capacity of: - 1 tank - 2,500.00 l, - 2 tanks - 5,000.00 l / each. The expected consumption of diesel fuel per week is 3.5-4 thousand l. Oil deliveries will be ordered by phone or e-mail to the e-mail address indicated by the Contractor. Oil deliveries will be made by the Contractor's means of transport and at his expense. The oil should be delivered by a specialized transport vehicle equipped with a legalized system for measuring the pumped out fuel. Vehicles transporting diesel fuel must meet all the requirements set out in the law on the international carriage of dangerous goods by road (ADR). The quality of the offered fuel should meet the requirements contained in the applicable regulations, in particular in the Act of 25 August 2006 on the fuel quality monitoring and control system (i.e. Journal of Laws of 2022, item 1315, as amended) in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended) and the requirements specified in the PN-EN 590+A1:2017-06 standard. Each delivery should be confirmed by a delivery note or a Contractor's GIN document, containing the date of delivery and the quantity of diesel fuel delivered with a reference temperature of 15oC. The Contractor shall provide the Ordering Party with a printout from the tank truck containing information about: - the amount of fuel dropped into the storage tank at a reference temperature of 15oC, - the number of liters of fuel at the actual temperature of the fuel dropped. At each fuel delivery, the Contractor must provide a current fuel quality certificate, certified by the manufacturer or the approval of an accredited laboratory, in Polish. The certificate shall be linked to the Contractor's delivery note or GIN by indicating the number and date of delivery. The Contractor will include in its offer the cost of supplying fuel to the ZGO Plant with its registered office in Pukinina No. 140, Rawa Mazowiecka commune. The Ordering Party informs that in accordance with the Act of 9 March 2017 on the system of monitoring road and rail transport of goods and trade in heating fuels (i.e. Journal of Laws of 2021, item 1857), as amended, the Contractor is obliged to register and update each fuel delivery on the PUESC platform (Platform of Electronic Fiscal and Customs Services). The Contractor is obliged to send to the Ordering Party's e-mail address (odpady@zgoaquarium.pl) the reference number and key generated in the PUESC system for subsequent confirmation (closing) by the Ordering Party of the fuel supply. The Ordering Party reserves the right to carry out a random inspection of the delivered diesel fuel in terms of quality and compliance with the provided quality certificate, by taking samples and performing tests. In the event of a dispute arising between the parties over the quality of the delivered diesel fuel, in the presence of a representative of the Contractor and the Ordering Party, three samples will be taken and sealed, which will be sent to an accredited laboratory. If the laboratory confirms the non-compliance of the delivered diesel fuel with the PN-EN 590+A1:2017-06 standard, all costs related to conducting tests and repair costs resulting from poor oil quality shall be borne by the Contractor. Otherwise, these costs shall be borne by the Ordering Party. The Contractor is obliged to have civil liability insurance in the scope of business activity.
