The subject of the contract is the supply of electricity within the meaning of the Act of 10 April 1997. Energy Law (i.e. Journal of Laws of 2021, item 716, as amended) for the needs of PKM Jaworzno with a total estimated volume of 5,000,000 kWh, the number of 10 collection points in the delivery period, i.e. not earlier than from 01.01.2023 to 31.12.2023

Energy Law (i.e. Journal of Laws of 2021, item 716, as amended) for the needs of PKM Jaworzno with a total estimated volume of 5,000,000 kWh, the number of 10 collection points in the delivery period, i.e. not earlier than from 01.01.2023 to 31.12.2023,
The Ordering Party reserves that to individual points of electricity consumption, specified in detail in Annex 1 to the SWZ, the commencement of deliveries will take place on the date indicated in point 6.1, but not earlier than after the effective termination of the existing energy supply contracts and a positively conducted procedure for changing the seller. The Contractor will perform all actions and arrangements with the Distribution System Operator (DSO) necessary to carry out the procedure of changing the seller and effectively start selling electricity, including in particular: termination of existing comprehensive agreements, notification to the DSO of new contracts for the sale of electricity. These activities will be performed by the Contractor on the basis of appropriate powers of attorney granted with the conclusion of contracts for the sale of electricity.
The supply of electricity will take place for the needs of facilities qualified to 3 groups according to the following classification (size subject to the right of option)
electricity for tariff group B23 3 350 000,00 kWh
electricity for tariff group C21 1 500 000,00 kWh
electricity for tariff group C11 150 000,00 kWh
The Ordering Party declares that the amount of electricity consumption specified above is an approximate expected amount and is used to compare offers. During the execution of the order, it may be increased by max. 20%, in accordance with the option right established by the Ordering Party, within the meaning of the provisions of Article 441 of the Public Procurement Law, in relation to forecasts concerning the Ordering Party.
The selected Contractor must have a contract for the provision of electricity distribution services, the so-called general distribution agreement (GUD) concluded with the local Distribution System Operator (DSO), which enables the sale of electricity to customers in the area of operation of TAURON Dystrybucja S.A.
The supplied electricity must meet the quality parameters and sales standards regulated in the Energy Law.
