3.1. The object of the order is:

Part II: handling the purchase and supply of energy confirmed by RES guarantees of origin, handling the settlement of energy generated in the participants' installations on the principles of the "old prosumer" and repurchase of surplus energy generated in the participants' installations on the principles of the "new prosumer"* in the period 01.01.2024 to 31.12.2024

3.2. A detailed description of the subject of the contract is attached as Annex 2 to the SWZ.
3.3. Acting pursuant to Article 18(4) of the Public Procurement Law, the Contracting Authority reserves that the documentation referred to in point 2.16 of the OPZ (Annex 2 to the SWZ) is confidential, and the Contractors who gain access to it are obliged not to disseminate it and not to use it for purposes other than the preparation of the offer and possible implementation of this contract, under pain of liability for damages. This documentation is not and will not be publicly published on the Ordering Party's website. The basis for making this documentation available is the submission of the "Application for access to documentation" – Annex 8 to the SWZ, which must be prepared in Polish.
8.2. The condition for commencing electricity deliveries within the dates indicated in point 8.1 of the SWZ is a positive implementation of the procedure of changing the seller, possession by the electricity consumer of a valid contract for the provision of electricity distribution services and effective termination / expiry of existing contracts for the sale of electricity / comprehensive agreements.
9.2. Agreements for handling the settlement of energy generated in the participants' installations on the principles of the "old prosumer" and repurchase of surplus energy generated in the participants' installations on the principles of the "new prosumer" will be concluded on the Contractor's contract templates, taking into account the rules resulting from the procurement documents.
