The subject of the contract is the supply of electricity in the period from 1 January 2023 to 31 December 2025 for 13 participants of the Self-Government Electricity Purchase Group (known as SGZEE) in a total estimated volume of 48 440 298.0 kWh to 932 PPE on the principles set out in the Act of 10 April 1997 Energy Law (Journal of Laws of 2020, item 833, as amended) and implementing acts issued on the basis of it.
2.1 The subject of the contract is the supply of electricity in the period from 1 January 2023 to 31 December 2025 for 13 participants of the Self-Government Electricity Purchase Group (known as SGZEE) in a total estimated volume of 48 440 298.0 kWh to 932 PPE on the rules set out in the Act of 10 April 1997 Energy Law (Journal of Laws of 2020, item 833, as amended) and implementing acts issued on the basis of it.
2.2 The supply of electricity in this public procurement will be carried out in the period from the date of conclusion of the contract, but not earlier than 1 January 2023 to 31 December 2025.
2.3 The supply will be provided by purchasing the required energy volume in three annual contracts, respectively for the years: 2023, 2024, 2025 (according to the indices BASE_Y-23, BASE_Y-24, BASE_Y-25 listed on the Polish Power Exchange, i.e. TGE). The date and conditions of purchase will be decided by the Authorized Ordering Party or another entity (person) duly authorised (a). The Contractor undertakes to cooperate in the assessment of trends prevailing on the energy market prepared by the Authorised Contracting Authority or another entity (a) duly authorised person (s). The actual value of the contract will therefore depend on the purchase prices of individual annual contracts Y-23, Y24, Y25 and the Contractor's margins and compulsory charges (excise duties, property rights, taxes, etc.). The method of determining the price conditions of supplies is described in detail in the template of the Sales Agreement — Appendix No. 8 to the SWZ.
2.4 The total number of SGZEE participants is 13 entities as at the date of submission of the announcement of the procedure for publication.

2.6 The measurement systems of tariff group B are adapted to the procedure for changing the seller.
2.7 Annex 1 to the OPZ identifies the current electricity supplier for individual Customer.
2.8 Distribution services will be provided on the basis of separate agreements concluded between Customers and local distribution system operators (DSOs).
2.9 The Contracting Authority envisages a reduction or increase in the number of electricity outlets resulting from natural management processes. The changes will not result in more than +/ -15% exceeding the energy consumption specified in the 2.1 OPZ.
2.10 The Contracting Authority requires that Contractors applying for a contract award at the date of submission of tenders have an existing contract concluded with local Distribution System Operators, i.e. Enea Operator Sp. z o.o., Energa Operator SA, on the basis of which energy sales can be carried out electricity through the distribution network of these DSOs to all the points of electricity collection indicated by the Zmipawic in Annex 1 to the OPZ.
2.11 The contract will be awarded in total for all electricity receipt listed in Annex 1 to the OPZ for the specified period and delivery address.
2.12 As a result of the resolution of the proceedings, Energy Sales Agreements will be concluded with individual electricity customers in the breakdown specified in column B of the EXCEL table of Annex 1 to the OPZ — refers to the column called “L.P. of the agreement” and the information contained therein informs the Contractor about the actual number of contracts to be signed.
