Description:

1. The subject of the contract is the provision of a comprehensive service within the meaning of Art. 3 point 30 of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2018, item 755, as amended) in the scope of comprehensive energy supply, including the sale and provision of energy distribution or transmission services the needs of facilities located on the premises of the Employer KOWR OT in Szczecin, specified in detail in Annex 1, divided into partial tasks:

1) partial task A - Branch of the Company Archives in Łobza ul. Gen. J. Bema 30, 73-150 Łobez, POLAND,

2) partial task B - Branch Section in Pyrzyce ul. Warszawska 95, 74-200 Pyrzyce, POLAND

3) partial task C - Branch Section in Stargard, Local Office in Recz, ul. Srebrna 22, 73-210 Recz, POLAND,

4) partial task D - Residential building located at Mirowo 26, 74-506 Moryń, POLAND,

5) partial task E - Gospodarstwo Rolne Sadlno 7, 72-350 Niechorze, POLAND.

2. A detailed description of the subject of the contract, in Annex 1 to the ToR


1) partial task A - Branch of the Company Archives in Łobza ul. Gen. J. Bema 30, 73-150 Łobez, POLAND

Comprehensive electricity supply, including the sale and provision of distribution or transmission services will take place under the conditions set out in: the provisions of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2018, item 755, as amended), executive provisions to this Act, in particular the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the operation of the power system (Journal of Laws of 2007, No. 93, item 623, as amended), at fixed prices and rates for the sale of electricity specified in the price form, fees and distribution rates in accordance with the current tariff of the Distribution System Operator (DSO Tariff) approved by the President of the Energy Regulatory Office, the Instructions for the Operation and Maintenance of the Distribution Network (IRiESD) and generally applicable legal provisions. Electricity should meet the technical parameters in accordance with the provisions of the Act of 10.4.1997 - Energy Law

(Journal of Laws of 2018, item 755, as amended) and implementing regulations to this Act and Polish Standards.

4. The awarding entity shall award the contract for a comprehensive service within the meaning of Art. 3 point 30 of the Energy Law, implemented on the basis of a comprehensive agreement referred to in art. 5 paragraph 3 of the same Act.

5. Electricity should meet quality and technical parameters in accordance with the provisions of the Energy Law and executive regulations to this Act and Polish Standards.

6. The Purchaser reserves the right to change the subject of the contract consisting in excluding individual properties from the contract in the event of their administration being discontinued. The Employer is obliged to inform the Contractor in writing or electronically about the cessation of administration of the given object within 3 days from the date of signing the contract on the cessation of administration of the given object at the latest. The Employer, together with a written notification, will send the Contractor a report of the transfer of the facility to the new buyer with written meter readings.

7. The demand for electricity specified by the Employer in Annex 1 are estimated quantities and are only indicative, used to calculate the value of the contract, which does not reflect the actual or declared use of electricity during the duration of the contract and in no case constitutes Purchaser, obligations to purchase energy in the amount indicated. The Purchaser reserves the right to reduce the quantities in question. The Contractor shall not bring any claims against this Employer. The settlement will be based on actual electricity consumption in kWh based on the current indications of measuring and billing systems.


2) partial task B - Branch Section in Pyrzyce ul. Warszawska 95, 74-200 Pyrzyce, POLAND

Comprehensive electricity supply, including the sale and provision of distribution or transmission services will take place under the conditions set out in: the provisions of the Energy Law of 10.4.1997 (i.e. Journal of Laws of 2018, item 755, as amended), executive provisions to this Act, in particular the Regulation of the Minister of Economy of 4.5.2007 on detailed conditions for the functioning of the power system (Journal of Laws of 200, No. 93, item 623, as amended), at fixed prices and rates for the sale of electricity specified in the price form, fees and distribution rates in accordance with the current tariff of the Distribution System Operator (DSO Tariff) approved by the President of the Energy Regulatory Office, the Instructions for the Operation and Maintenance of the Distribution Network (IRiESD) and generally applicable legal provisions. Electricity should meet the technical parameters in accordance with the provisions of the Act of 10.4.1997 - Energy Law

(Journal of Laws of 2018, item 755, as amended) and executive ordinances to this Act and Polish Standards.
