Article 6 of the General Regulation on ESI No 1303/2013 provides that 'Transactions supported by ESI Funds' must be 'in conformity with applicable Union legislation and national law relating to its application (referred to as 'Applicable Law'). ' In addition, public order represents a significant financial amount. Public procurement is an important part of public investment: almost 20% of EU GDP (1/5 th). It is estimated that almost half of the EFSF is spent on public procurement. Therefore, the EU authorities are very vigilant on the issue of public order:

— as a result of these large amounts,

— but also because it is a theme conducive to irregularities, even fraud.
