Contractual penalties (§ 11 VOB / B)

If the specified individual deadlines or the deadline for completion are exceeded, the contractor must pay as a contractual penalty for each working day of the delay: 0.15 percent. H. the order amount stated in the order letter excluding sales tax; Amounts for offered maintenance services are not taken into account. The reference value for calculating the contractual penalty when individual deadlines agreed as a contractual period are exceeded is the part of this order amount that corresponds to the services to be contractually provided up to this point in time. The contractual penalty is increased to a total of 5 percent. H. of the order amount stated in the order letter (excluding sales tax).
