1. The subject of the contract is the supply of electricity for the years 2023-2025 to the contracting authority/entities to electricity consumption points. A detailed description of the subject of the contract, including the names and locations of the facilities, the forecasted demand for electricity during the term of the contract, types of tariffs, contractual capacity, place of delivery and necessary data for the conclusion of the contract is included in Appendix 8.
2. The values indicated in Annex 8 are estimates, which do not reflect the real or declared use of electricity during the term of the contract and in no case can be the basis for any claims on the part of the contractor.
3. Actual settlements will take place on the basis of current indications of metering and settlement systems for the supply of electricity in accordance with the contractor's offer and will take place on the basis of fees resulting from the tariff for energy distribution services of the relevant distribution system operator.

3. The supply of electricity shall be carried out under the conditions specified in the provisions of the Act of 10 April 1997. Energy Law (i.e.: Journal of Laws of 2020, item 833, as amended, hereinafter referred to as the "Energy Law"), in accordance with the applicable regulations to the above-mentioned Act and the provisions of the Act of 23 April 1964 - Civil Code (i.e. Journal of Laws of 2019, item 1145, as amended, hereinafter referred to as the "Civil Code"), the rules set out in concessions, the provisions of this Agreement and based on the PPL Act, implementing regulations to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on specific conditions for the operation of the power system, tariff for electricity distribution services of the relevant distribution system operator (DSO tariff), Distribution Network Operation and Operation Manual (IRiESD) and generally applicable legal regulations.
4. The contractor shall be obliged to have, as at the date of commencement of the service, a comprehensive agreement with the distribution system operator to whose network the contracting authority's facilities are connected, enabling the provision of energy supplies for the facilities covered by the contract. In the absence of such an agreement, the contracting authority/entity shall authorize the contractor to conclude it.
