The subject of the contract is the provision of technical support and technical assistance of the electronic fishing logbook software "e-logbook System" for the period.
1. The Ordering Party informs that it does not hold any proprietary copyrights to the electronic fishing logbook system "e-logbook system". The owner of the source codes for the software of the Electronic Registration and Electronic Reporting System for Fishing Activities is Decsoft S.A., which holds exclusive copyrights to modify the above-mentioned software.
2. The Contractor shall ensure a sufficient number of persons and resources to perform the contract smoothly and properly.
3. A detailed description of the subject of the contract and the conditions regarding the implementation of the subject of the contract can be found in the model contract constituting Annex 1 to the SWZ.
4. The subject of the contract is not divided into parts. Support services are indivisible for technical reasons. Entities operating on the IT market provide comprehensive services in technical support and technical assistance of software. Conducting the order by one Contractor who specializes in comprehensive service guarantees proper and timely
performance of the order. As a rule, the division of the contract into lots should result in broadening the circle of Contractors, including an increase in the participation of the small and medium-sized enterprises sector
(SMEs) in the public procurement market, which in turn affects the rationalization of public spending (a larger number of Contractors has a positive impact on the competitiveness of bid prices).
In the opinion of the Contracting Authority, both the scope and size of the contract fully correspond to the capabilities and specialization of the entities to which the contract is addressed (in particular, SMEs). Therefore, the lack of division does not violate the principles expressed in Article 16(1) of the Act, i.e. the principle of competition and equal treatment of Contractors.
