For the order, in accordance with the list set out in Annexes No 2A and 2B to SWZ. The scope of the order includes the sale and distribution of electricity to indicated entities in the year 2022, in a quantity in line with the estimated demand of approximately 116,864,323.92 kWh.

2. Forecast electricity consumption during the term of the contract for each Contracting Authority shall be:
For Street and Road Lighting sp. z o.o. (OUiD) - 61 188 873,00 kWh
For the Commons together with the organisational units and other entities - 55,675 450,92 kWh

3. The estimated quantity of supply does not constitute on the part of the Contracting Authority an energy consumption obligation in the quantity given and in no case may be the basis for any claims on the part of the Contractor. The actual quantity of energy purchased confirmed by the indications of the measurement and settlement systems during the implementation of the contracts will result only from the current needs of the Ordering Party, and the prices determined by the Contractor in the offer will be binding on the Contractor regardless of the actual quantities. Pursuant to Article 433 (4) of the Law, the Contracting Authority declares that a reduction in the amount of energy ordered will not occur by more than 50% of the original scope of the contract. The above circumstance, i.e. reducing the amount of energy procured to the indicated percentage will not affect the change in the amount of the Contractor's unit rates. Electricity supplies will meet the quality standards set out in the Energy Law Act and implementing acts.
4. Contractors have the right to modify the quantity (increase, decrease) of electricity consumption points during the course of the contract subject, with the price rates specified in the Tender Form also applicable for new/additional electricity collection points.
5. The supply of electricity will be carried out under the terms of a comprehensive service

6. Settlements between the parties for the provision of a comprehensive supply of electricity service will be carried out in accordance with the provisions set out in the draft contracts constituting Annexes Nos 9A and 9B to the SWZ.
