The subject of the contract is the supply of electricity to the facilities of Miejskie Przedsiębiorstwo Energetyki Cieplnej Spółka z o.o. Towarowa 9, 22-100 Chełm in the period from 01.01.2024 to 31.12.2024. in a total estimated amount of 3 693 290 kWh over a period of 12 months. The list of facilities and energy consumption points (PPE) can be found in Annex 9 to the SWZ.

1. The subject of the contract is the supply of electricity to the facilities of Miejskie Przedsiębiorstwo Energetyki Cieplnej Spółka z o.o. Towarowa 9, 22-100 Chełm in the period from 01.01.2024 to 31.12.2024. in a total estimated amount of 3 693 290 kWh over a period of 12 months. The list of facilities and energy consumption points (PPE) can be found in Annex 9 to the SWZ.

2. Currently, the purchase of electricity and distribution services for electricity consumption points are provided on the basis of comprehensive agreements concluded for an indefinite period with PGE Obrót S.A Zamość Branch.

3. The Ordering Party undertakes to terminate comprehensive agreements and conclude agreements with the local Distribution System Operator, i.e. PGE Dystrybucja S.A. Zamość branch.

4. The Contractor shall undertake to submit to the Distribution System Operator, on behalf of the Contracting Entity, a notification on the conclusion of an electricity sale agreement.

5. The Contractor shall present the Offer Calculation in Appendix 1.1 Price Form.

6. The commencement of a comprehensive supply of electricity to individual electricity consumption points, specified in detail in Annex 9 to the SWZ, will take place not earlier than after a positive procedure of changing the supplier, in accordance with the relevant provisions of generally applicable law, including in particular the Energy Law and the Distribution Network Operation and Operation Manual, developed by a given distribution system operator and approved by the President of the Energy Regulatory Office).

7. The expected amount of electricity in the delivery period (from 01.01.2024 to 31.12.2024) is 3 693 290 kWh, including:

Tariff B23: zone 1-462 013 kWh; Zone 2-357 526 kWh; Zone 3-1 938 243 kWh;

Tariff C12a: Zone 1-104 968 kWh; Zone 2-306 449 kWh;

Tariff C11: zone 1-524 091 kWh.

8. The actual amount of electricity will depend on the actual needs of individual electricity consumption points of the Ordering Party. Regardless of the amount of electricity consumption, the Contractor will be obliged in each case to apply unit prices of electricity from the offer. The contracting authority guarantees energy consumption in the amount of 70% of the estimated amount indicated in point 7.

9. Meter readings shall be carried out:

Tariff B-23 - 1 time per month, together for each measuring system 12 readings,

Tariff C12A - 1 time in 2 months, together for each measuring system 6 readings,

Tariff C11 - 1 time in 2 months, together for each measuring system 6 readings.

10. Invoices for consumed electricity must be submitted by the 10th day of each month.

11. The Contractor shall complete all formalities related to the procedure applicable to the change of electricity supplier.

12. The Contractor shall be the excise duty payer for the electricity consumed.

13. The Ordering Party declares that the Distribution System Operator is PGE Dystrybucja S.A. branch in Zamość, for facilities listed in Annex 9 to the SWZ.

14. The Contracting Authority does not allow partial bids.

15. The Purchaser does not allow submission of variants.
