1. The subject of the order is:
1.1. supply of electricity to facilities listed in Annex 3 – description of the subject of the contract on electricity demand within 12 months in the amount of 9 190 361.74 kWh (basic order) 11 028 434.09 kWh (with the right of option +20%),
1.2. performing activities resulting from the power of attorney, constituting an annex to the Agreement.
Number of ppe and estimated kWh within tariff groups: ppe 539, kWh (basic order) 9 190 361,74. The detailed scope of the contract is specified in Annex 3 to the SWZ, in accordance with the provisions of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2022, item 1385, as amended). Other conditions regarding the performance of the contract are specified in the draft electricity sales contract – Annex 8 to the SWZ.
The supply of electricity will take place under the conditions specified in the provisions of the Act of 10 April 1997 – Energy Law and in accordance with the implementing regulations issued to this Act, in particular with the standards of quality of customer service set out in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading (Journal of Laws 2022.2505, as amended).
Electricity is to meet the technical parameters in accordance with the provisions of the Energy Law and its implementing regulations.
2. Distribution services will be provided on the basis of a separate agreement concluded by the Ordering Party with the relevant Distribution System Operator.
3. Requirements for the Contractor: performance of activities resulting from the power of attorney constituting an attachment to the Electricity Sales Agreement. The Contracting Authority shall grant the Contractor selected in the proceedings a power of attorney to:
3.1. notify the relevant Distribution System Operator about the conclusion of the electricity sale agreement and about the planned date of commencement of electricity sales,
3.2. termination of existing contracts for the sale of electricity and provision of distribution services (comprehensive agreements) or contracts for the sale of electricity by mutual agreement of the parties to the current seller of electricity and distribution services or seller of electricity for all energy consumption points included in Annex 1 to the agreement,
3.3. obtain, if necessary, information from the current seller about the number, date of conclusion, term and notice period of the existing contract for the sale of electricity and the provision of distribution services, or the contract for the sale of electricity,
3.4. representing the Ordering Party before the relevant Distribution System Operator during the process of concluding Distribution Agreements, including signing and submitting on behalf of the Ordering Party an application for the conclusion of a distribution agreement,
3.5. representing the Contracting Authority before the Distribution Network Operator in matters related to the conclusion of a contract for the provision of distribution services for a new connection (no existing agreement), including signing and submitting on behalf of the customer an application for connecting the receiving installation to the grid,
3.6. apply to the Distribution Network Operator with a request to change the payer, address data of the PPE, tariff group, contractual capacity for electricity consumption points specified in the Annex to the Agreement during the performance of the contract at the prior request of the Ordering Party,
3.7. representing the Ordering Party in contacts with the current Electricity Seller or Distribution System Operator in matters related to the process of changing the Seller, applies to the points included in the Annex to the Agreement.
