The proceedings are conducted on the basis of the provisions of the Act of 11 September 2019. Public procurement law – hereinafter referred to as the 'PPL Law' – and implementing regulations issued on its basis,
in particular, the Regulation of the Minister of Development, Labour and Technology of 30 December 2020 on subjective means of evidence and other documents or statements that the contracting authority may request from the contractor – hereinafter referred to as the "MR Regulation" –
in the open tender procedure.
1 The subject of the contract is the supply of boats, slip trailers and outboard trailers as part of the task entitled "Purchase of boats with outboard engines to maintain the shipping route 8 pcs. and slip trailers 2 pcs., ZPT ZZ Włocławek, Kujawsko-Pomorskie province".
The scope of the contract includes:
- delivery 8 pcs. rowing and motor boats,
- delivery of 2 pcs. launching trailers for the maintenance of the shipping lane, and
- delivery 8 pcs. four-stroke outboards
1.1. A detailed description of the subject of the contract is included in Appendix No. 2 to the SWZ "DESCRIPTION OF THE SUBJECT OF THE CONTRACT". The order must be made in accordance with the requirements set out in the "Description of the subject of the contract" (Annex No. 2 to the SWZ) and the draft provisions of the contract (Annex No. 8 to the SWZ).
1.2. The Contractor is obliged to fill in - Specification of the delivered equipment - point 5 of the Offer Form. Selecting the "No" option and/or the incompletely filled "Contractor's Declaration" column may result in the Contractor's request for explanations or rejection of the Contractor's offer.
1.3 The Contractor shall provide the Contracting entity with a quality guarantee and warranty for a period not shorter than indicated in the offer form.
1.4. The Ordering Party has made every effort to ensure that the description of the subject of the contract does not include any trademark, patent or origin, source or specific process that characterizes products or services provided by a specific Contractor. If the procurement documents indicate a trademark, patent or origin, source or specific process, this is for information purposes only. If the description of the subject of the contract contains a reference to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 paragraph 1 point 2 and paragraph 3 of the Public Procurement Law, the Contracting Authority allows offering solutions equivalent to those described, provided that the proposed solutions meet the requirements specified in the description of the subject of the contract to an equivalent degree. In the case of offering solutions equivalent to those specified in the description of the subject of the contract, the Contractor is obliged to meet the requirement resulting from Article 101(5) and (6) of the Public Procurement Law.
