The scope of the contract includes:
a) collection, transport and management of the entire mass of municipal waste generated, both mixed and selectively collected, generated on real estate on which residents live, located within the administrative boundaries of the municipality of Mszczonów, regardless of weather conditions;
b) collection and management of municipal waste collected in a selective manner from the Selective Municipal Waste Collection Point.
A detailed description of the subject of the contract was described by the Ordering Party in SWZ.
1. The scope of the subject of the contract includes:
a) collection, transport and management of the entire mass of municipal waste generated, both mixed and selectively collected, generated on real estate on which residents live, located within the administrative boundaries of the municipality of Mszczonów, regardless of weather conditions;
b) collection and management of municipal waste collected in a selective manner from the Selective Municipal Waste Collection Point.
2. The subject of the contract shall be carried out in such a way as to ensure that appropriate levels of recycling, preparation for re-use and recovery are achieved by other methods and that the weight of biodegradable municipal waste sent to landfill is reduced.
3. The Ordering Party shall not allow the submission of partial tenders. The contracting authority shall not divide the contract into lots according to the subject of the contract and excessive technical difficulties, including difficulties in coordinating the activities of different contractors performing individual parts of the contract and the costs of performing the contract.
4. The Contracting Authority shall not permit the submission of variant tenders and in the form of electronic catalogs.
5. Pursuant to Article 214(1)(7) of the PPL Act, the Ordering Party provides for the repetition of similar services as for the basic contract consistent with the subject of the basic contract, and consisting in: - the scope of the contract:
a) collection, transport and management of the entire mass of municipal waste generated, both mixed and selectively collected, generated on real estate on which residents live, located within the administrative boundaries of the municipality of Mszczonów, regardless of weather conditions;
b) collection and management of municipal waste collected in a selective manner from the Selective Municipal Waste Collection Point. - conditions for the award of the contract: conclusion of another contract for the above-mentioned scope of the contract, for the period after the expiry of the contract concluded as a result of this procedure.
The condition will be met if the Contractor demonstrates that it has: a current entry in the register of regulated activities in the field of collecting municipal waste from property owners, referred to in the provision of Article 9b of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities, in the scope of all types of waste covered by this proceeding;
a) current entry in the register of entities introducing products, products in packaging and waste management (BDO register) in accordance with the requirements of Article 49(1) of the Waste Act of 14 December 2012.
- the estimated value of this contract: not more than 50 % of the value of the basic contract.
6. Pursuant to Article 95(1) of the PPL Act, the Contracting Authority shall require the Contractor, subcontractor or sub-subcontractor to employ persons performing the following activities in the scope of the contract performance on the basis of an employment relationship, within the meaning of the Act of 26 June 1974 – Labour Code:
(a) workers performing a municipal waste management service;
(b) employees operating facilities of municipal waste processing facilities;
(c) workers carrying out waste sorting activities;
d) persons performing activities consisting in the collection of municipal waste (i.e. persons directed to load waste on cars and drivers);
unless the services referred to in points a, b, c or d are carried out by the person concerned in the framework of his business activities.
7. A detailed description and method of performing the order is contained in the "SOPZ"-Appendix No. 7 to the SWZ and the Model Agreement - Annex No. 6 to the SWZ.
8. The applicable remuneration for the contractor will be a lump sum remuneration pursuant to Article 632 of the Civil Code.
9. The Contracting Authority does not provide for the obligatory completion of a local inspection by the Contractor.
10. The deadline for collecting waste from PSZOK is one of the criteria for the evaluation of offers.
