Concession of the management of the municipal nursery school "Gemma Missaglia" for the period from 01/09/2023 to 31/08/2028

The concession concerns the management of the nursery service 0-3 years, for the school years 2023/2024- 2024/2025 - 2025/2026 - 2026/2027 - 2027/2028, with the possibility of renewal for a further 2 (two) school years in the building owned by the municipality, located in via Salvioni, 1 - Somma Lombardo

The concession concerns the didactic – educational service as a whole.

The concession concerns the integral management of the Nursery, understood as a set of educational, auxiliary, managerial and administrative services necessary for its operation, to be carried out by the Concessionaire in the name and on behalf of the Municipality of Somma Lombardo, at its own care, risk and expense, in constant integration with other local educational services, within the framework of general policy, early childhood training of the Local Authority.

The management of the service also includes the following supplementary activities: planning activities (with elaboration of the annual plan), documentation, evaluation, training and updating, relations with families, with the Municipal Administration and the socio-health and educational services of the territory and the kindergarten.

This service, understood as a "socio-educational service" of public interest, must be carried out by the Concessionaire with its own organization, in compliance with and according to the procedures provided for in these specifications, in the Municipal Regulations in force, as well as in the educational and organizational project presented at the time of the offer.

The public nature of the service places in charge of the Administration the general functions of planning and direction of it and the evaluation of its objectives of public interest with consequent power to modify the clauses of the agreement and the methods of providing the service even unilaterally according to changed conditions of context and evolution of needs, up to the power to revoke the concession, without prejudice to the application of current legislation relating to charges resulting from changes in the economic and financial balance of the concession.

The Nursery Service, object of this concession, being of a public interest, cannot be suspended or abandoned for any reason, partially and / or temporarily.

The structure is authorized to operate for a maximum structural capacity of 47 children, divided into:

SMALL ROOM: made up indicatively of children aged 3 to 12 months;

MEDIUM ROOM: made up of children aged 12 to 24 months;

LARGE ROOMS: made up of children aged 24 to 36 months.

The property, fixed installations and necessary equipment are delivered to the Concessionaire before the start of the concession and for the entire duration of the concession, in the state in which they are located, exclusively for the management of the activity subject to the concession. The list of fixed installations, main equipment and movable property is attached to this document.

The Concessionaire is responsible for the correct and conscious use of the goods and equipment made available by the Municipality, both by employees, any subcontractors and users.

The Dealer carries out all foreseeable routine maintenance operations with the diligence of the user. For the purposes of starting the concession, a report of delivery of the property will be drawn up, including an analytical inventory descriptive of the state of conservation of the property and furniture, in contradictory between the parties. Upon expiry, the Concessionaire is required to return the property, fixed installations and equipment, in good condition and operation, without prejudice to the deterioration produced by normal use. The return must result from a special return report, drawn up in the same way. Any damage to movable and immovable property and any shortages of movable property must be repaired or reinstated within a reasonable period that will be fixed in agreement in the report.

After the deadline has elapsed, the Municipal Administration will have the right to claim the final deposit for an amount equal to the cost of restoring the damaged goods, or to the market cost for those missing.
