1. The subject of the contract is the service of collection and management of municipal waste with the following codes:
1) 20 03 01 – mixed municipal waste,
2) 20 01 01 – paper and cardboard,
3) 20 01 02 – glass,
4) 20 01 39 – plastics,
5) 20 01 40 – metals,
6) 20 01 08 – biodegradable kitchen waste.
2. The scope of the contract also includes the service of collection and management of waste arising from the construction, renovation and dismantling of construction facilities (divided into wood, metals, glass, plastics, gypsum, mineral waste, including concrete, brick, tiles and ceramic materials) for an additional order (notification) of the Ordering Party
3. The service shall also include the collection of hazardous and non-hazardous waste.
4. The service will be provided in the city of Warsaw at the following addresses: Al. Niepodległości 218, Klonowa 1, Klonowa 2, Klonowa 6, Rakowiecka 2, Puławska 4a, Rakowiecka 4a.

5. The description of the subject of the contract shall include in particular:
1) Detailed description of the subject of the contract – Annex 3 to the SWZ,
2) Draft provisions of the agreement – Annex 2 to the SWZ,
3) Quantity and type of waste, containers and containers and the frequency of their collection – Annex 14 to the SWZ,
4) Price form – Annex 13 to swz.
3. Requirements regarding the deposit and securing the proper performance of the contract, the Ordering Party requires the submission of a deposit and security for the proper performance of the contract.
VADIUM
1. The Contractor is obliged to lodge a deposit in the amount of: PLN 20,000.00 (in words: twenty thousand 00/100)
2. A tendering security may be lodged at the choice of the economic operator before the expiry of the time limit for the submission of tenders in one or more of the following forms:
1) money;
2) bank guarantees;
3) insurance guarantees;
4) the surety provided by the entities referred to in Article 6b (5) (2) of the Law of 9 November 2000 on the establishment of the Polish Enterprise Development Agency (Journal of Laws of 2020, item 299).
3. The deposit lodged in money shall be paid by bank transfer to a bank account16 1010 1010 0041 8313 9120 0000.
4. The security lodged in money must be described in such a way as to enable it to be identified, by stating the case sign: 21/ZP/22.
5. The security in money shall be effectively lodged when the funds are credited to the contracting authority's bank account referred to in paragraph 3, before the deadline for the submission of tenders (i.e. before the expiry of the day and time set as the final date for the submission of tenders).
6. The bid bond lodged in money shall be kept by the ordering party on a bank account.
PERFORMANCE GUARANTEE
1. The Contractor whose offer will be selected shall be obliged to lodge a security for the proper performance of the contract at the latest on the date of its conclusion, in the amount of 5% of the gross contract value.
2. The security may be lodged, at the choice of the contractor, in one or more of the following forms:
1) money;
2) bank surety or surety of the cooperative savings and credit unions, with the fact that the obligation of the cash register is always a monetary liability;
3) bank guarantees;
4) insurance guarantees;
5) the surety granted by the entities referred to in Article 6b (5) (2) of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development.
3. The Ordering Party does not agree to lodge a security in other forms than those specified in paragraph 2.
4. Other information on the security and the performance security shall be contained in the SWZ
