Maintenance of urban green areas in the area of the Municipality of Mielec in the years 2023-2024 divided into two parts

The subject of the contract is year-round maintenance and maintenance of green areas in the Municipality of Mielec in the years 2023 - 2024:

Part I - maintenance of parks, squares, plantings and green areas located on the main communication routes, i.e. in particular:

(a) plantings of seasonal flowers and permanent plants,

(b) care for plantings,

(c) tree care,

(d) coughing up,

e) maintenance of elements of municipal infrastructure (benches, waste bins, bicycle racks, etc.) in the areas covered by the subject of the contract,

f) occasional decorating of memorial sites, hanging flags,

(g) collection and disposal of waste .

Part II – arrangement, mowing and maintenance of undeveloped green areas and parts of green belts along urban roads.

The subject of the contract in this part includes mowing and arranging (planting) green belts along urban roads and undeveloped green areas indicated by the Ordering Party, on the area of approx. 34 ha.

Part I - maintenance of parks, squares, plantings and green areas located on the main communication routes

1. The subject of the contract is the maintenance of parks, squares, plantings and green areas located on the main communication routes, i.e. in particular:.

(a) plantings of seasonal flowers and permanent plants,

(b) care for plantings,

(c) tree care,

(d) coughing up,

e) commemorative decoration of memory sites, hanging flags,

(f) the collection and export of impurities.

The detailed list of sites and the scope of works shall specify Annexes No 1, No 2 and No 3 to the model contract.

2. The contracting authority provides for the award of contracts consisting in the repetition of similar services referred to in Article 214(1)(7) of the PPL up to the amount of PLN 1 640 000 net.

3. Pursuant to Article 95 (1) of the Law, the Law of Public Procurement requires the employment of a contractor, subcontractor or a further subcontractor under the contract of employment of persons performing the work covered by the contract indicated in the description of the subject of the contract, including physical work, if the performance of these activities consists in the performance of work within the meaning of the provisions of the Act of 26 June 1974.

4. The Contracting Authority authorises execution of the contract with the participation of subcontractors.

5. The contracting authority provides for the application of the so-called reverse procedure referred to in Article 139(1) of the PPL, i.e. it will first examine and evaluate the bids, and then it will make a subjective selection of the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.

6. The Contracting Authority shall not provide for an electronic auction.

7. The Contracting Authority does not provide for the submission of an offer in the form of electronic catalogues.

8. The Contracting Authority shall not conduct proceedings for the conclusion of a framework agreement.

9. The Contracting Authority shall not reserve the right to apply for the award of a contract only by contractors referred to in Article 94 of the PPL.

10.The contracting authority does not provide for the submission of variant bids.

11.In accordance with Article 13(1) and (2) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (OJ L ...). UE L119 of 4 May 2016, p. 1; hereinafter referred to as "GDPR"), the administrator of personal data is the Municipality – Municipal Office of Mielec (contact: iod@um.mielec.pl, tel. +48 177874033). Personal data will be processed on the basis of Art. 6 para. 1 lit. c GDPR for purposes related to posting. Recipients of personal data. There will be persons or entities to whom the DOK will be made available. post. based on Article 74 of the PPL. Persons data. will be stored, in accordance with Article 78(1) of the Public Procurement Law. Obligation to provide personal data. is a statutory requirement related to participation in the proceedings. With regard to personal data, decisions will not be made by automated means in accordance with Art. 22 GDPR. Person kt. The data concerns:

(a) the right to access a person's data relating to him,

(b) the right to rectify a person's data relating to him,

(c) the right to require the controller to restrict the processing of the individual data subject to the duration of the proceedings and the cases referred to in Article 18 (2) of the GDPR,

(d) the right to lodge a complaint with the President of the Office for the Protection of Personal Data when it considers that the processing of a person's data relating to it violates the provisions of the GDPR.

The data subject does not have:

(a) in conjunction with Article 17 (3) (b, d or e GDPR, the right to delete the persons concerned. ,

(b) the rights to transfer data of persons. (Article 20 GDPR),

(c) the right to object to their processing (Article 6 (1) (c) of the GDPR).

Part II – maintenance of undeveloped green areas

1. Part II – arrangement, mowing and cleaning of undeveloped green areas and parts of green belts along urban roads.

The subject of the contract in this part includes mowing and arranging (planting) green belts along urban roads and undeveloped green areas indicated by the Ordering Party, located in areas managed by the Municipality of Mielec. The area of land indicated for regular maintenance in this area is approx. 34 ha. The scope of works together with the list of areas on which the works will be carried out is included in Annex 1 and No. 2 to the model contract.

2. The contracting authority provides for the award of contracts consisting in the repetition of similar services referred to in Article 214(1)(7) of the PPL up to the amount of PLN 367,500.00 net.

3. The Contracting Authority pursuant to Article 95 (1) of the Pzp Act requires the employment of a contractor, subcontractor or further subcontractor under the contract of employment of persons performing the work covered by the subject of the contract indicated in the description of the object of the contract, including physical work, if it diags those activities consists in the performance of work within the meaning of the provisions of the Act of 26 June 1974.
