The supply of gas will take place on the basis of a contract specifying the conditions for the sale and provision of gas transmission or distribution services (comprehensive contract) and will be executed in accordance with the provisions of the Act of 10 April 1997 Energy Law, Civil Code and regulations executive issued on their basis. Organisations shall conclude separately agreements arising out of this procedure for the award of public procurement under unlimited tender, the purpose of which is to ensure a comprehensive supply of high methane natural gas to these facilities within the period from 01.05.2022. until 31.12.2022r. The Contracting Authority acts on behalf of its own and on the basis of a signed agreement based on Article 38 of the Act of 11 September 2019—Public Procurement Law. The volume of gas intake is estimated at 15,746,054 kWh for the contracting party and those JST units of which an estimated 13,520 299 kWh will be subject to tariff protection under the Act of 26 January 2022 on specific solutions for the protection of gas fuel customers in connection with the situation on the gas market (Journal of Laws from 2022, item 202). Due to the nature of the order, the exact consumption of high methane natural gas covered by the subject of the contract cannot be determined. For this reason, the Ordering Party presented a predictable amount of high methane natural gas consumption. The Contracting Authority provides that the actual amount of consumption of high methane natural gas may change, i.e. increase or decrease while maintaining the offered unit prices. Thus, the projected consumption of high methane natural gas described does not constitute an obligation for the Contracting Authority to purchase high-methane natural gas at the specified amount. The Contracting Authority provides as part of the implementation of this order the right of options based on Article 441 of the Pzp Act. By option law, the Contracting Authority understands the possibilities of execution of the contract more broadly than those given in this proceeding. The right of options is the right of the Contracting Party which he may, but does not have to exercise in the implementation of this Agreement. The right of options will be to increase the volume of the volume of the ordered natural gas to 10% of the volumes indicated in Annex 10 to the SWZ by placing an appropriate order by the Contracting Authority concerned.
