Collection and transport of kitchen, medical, hazardous and non-hazardous waste to places of further development from the areas of military complexes administered by the 4th Military

The subject of the contract are services consisting in the collection and transport of kitchen, medical, hazardous and non-hazardous waste to places of further development from the areas of military complexes administered by the 4th Military Economic Branch in Gliwice divided into 3 parts / tasks.

The contracting authority stipulates that it may cancel the procurement procedure if public funds,

which the contracting authority intended to allocate to finance all or part of the contract, it did not have

granted.

Part No. 1 Collection and transport of kitchen waste to places of further development from the areas of military complexes administered by the 4th Military Economic Branch in Gliwice

A detailed description of the item of the order shall include the following annexes

• Appendix No. 2 – description of the subject of the contract for part/task from No. 1 to No. 3

• Annex No. 3.1 to 3.3 – price forms respectively for a given part / task

• Appendix No. 4 - Draft provisions of the Agreement for part/task No. 1 to No. 3.

The contracting authority requires for all parts of employment by the contractor or subcontractor on the basis of an employment contract, persons performing activities related to the implementation of the contract, indicated

in the description of the subject of the contract, i.e. in particular activities related to access to the place of waste collection, loading waste, tidying up the area, transport of waste to the places of processing (recovery/disposal). Employees must be employed under an employment contract within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1510) at least for the duration of the contract.

The requirement does not apply to, m.in. natural persons conducting business activity, incumbent members of the management or supervisory bodies of the contractor, partners in a general or partnership company, incumbent members of the management or supervisory bodies of the contractor, partners of a general partnership or partnership, to the extent that they will personally perform works for the Contracting Authority or the Contractor.

The method of verifying the employment of these persons, the power of the Contracting Authority to control the fulfillment of the requirements for the employment of those persons and the sanctions for failure to comply with these requirements are described in the proposed provisions of the contract (Annex 4 to the SWZ).
