The supply of electricity for the “Skrzat” Student's House of Humanities and Natural Sciences in Czestochowa
1. The subject of the order is the supply of electricity for the Student's House “Skrzat” of the Jan Dlugosz University of Humanities and Natural Sciences in Częstochowa.
2. Common Procurement Dictionary (CPV) codes: 09300000-2 Electricity, Thermal, Solar and Nuclear Energy, 09310000-5 Electricity.
3. The Contracting Authority shall not allow the submission of partial tenders.
4. The Ordering Party informs that the order includes the supply of electricity in the G11 tariff group – 150 000 kWh. A detailed description of the subject of the contract is attached as Annex 5 to the SWZ.
5. At the same time, the Contracting Authority informs that the following separate contracts are currently in force:
1) Distribution services contracts concluded for an unmarked period with Tauron Distribution S.A., Podgórska Street 25A, 31-035 Kraków, whereby the Ordering Party informs that these are not comprehensive agreements and does not provide for the conclusion of new contracts for the provision of distribution services.
2) Electricity sale agreement concluded with Respect Energy Spółka Akcyjna, with its registered office in Warsaw, Ludwika Rydygiera 8, for a definite period, until 17.08.2023.
6. The Ordering Party does not use promotional or loyalty offers.
7. The Contractor will be obliged to carry out on behalf of the Contracting Entity, on the basis of the power of attorney granted to him, the procedure of changing the electricity supplier, within the time enabling the commencement of energy sales on 18.08.2023. The Contracting Authority shall grant a power of attorney taking into account the provisions of the IRiESD DSO, while the scope of the power of attorney will correspond to the scope of the subject of the contract.
8. The data and documents necessary to carry out the procedure of changing the seller shall be provided by the Contracting Authority to the Contractor at the latest on the day of conclusion of the public procurement contract covered by the procedure in question (also in electronic version - Excel).
9. The Contractor shall hold for the entire duration of the contract concerning the contract in question, a general distribution contract concluded between the Contractor and the Distribution Network Operator responsible for the object covered by the contract.
10. The Contractor is obliged to act as a trade balancing entity for electricity sold under this Agreement.
11. The Ordering Party declares that he has legal title to the object covered by this order.

13. The Ordering Party shall not permit the submission of variant tenders.
14. The Contractor may entrust the execution of individual parts of the contract to the subcontractor, i.e. the entity with whom he has entered into a subcontracting contract as defined in Article 7 (27) of the Pzp Act. If the execution of the contract is entrusted to the subcontractor, the Contractor shall be responsible for the actions and omissions of such entity as his own.
15. The Ordering Party declares that it is an eligible customer within the meaning of the Act of 27 October 2022 on extraordinary measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws of 2022, item 2243).
16. Bearing in mind point 15, the Contractor may not apply in the offer a price for electricity higher than that indicated in Article 2 point 1) letter b of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and support for certain customers in 2023 (Journal of Laws of 2022, item 2243).
17. The bid of the Contractor who offers a price higher than that indicated in Article 2(1)(b) of the Act of 27 October 2022 on extraordinary measures aimed at limiting electricity prices and supporting certain customers in 2023 (Journal of Laws of 2022, item 2243) will be rejected pursuant to Article 226(1)(5) of the PPL.
