1. The subject of the proceedings is the conclusion of a framework agreement for the selection of intermediaries in obtaining and delivering to the Entities all types of licenses for the Manufacturer's software indicated in the Manufacturer's Price List, within the product categories indicated in Appendix No. 1A to the SWZ or software equivalent to technical support, and the provision of expert support services of the Manufacturer and consulting support of the Contractor in the scope of the delivered Manufacturer's software.
2. The Framework Agreement shall specify all the conditions for the delivery and the conditions for the selection of Contractors who deliver deliveries to Units from among the Contractors party to the Framework Agreement.
3. Procurement will be carried out successively, depending on the needs of the Units after the Unit has submitted an application for the contract, obtaining a reply from the Contractor to the request for the order and the choice of the Contractor who will perform the order in question (implementing procedure).

2. The purpose of a framework agreement is to lay down the terms governing contracts (performed under implementing agreements) that may be awarded during the term of the framework agreement as indicated in Chapter II. IV SWZ.
3. The framework agreement shall specify all the conditions relating to the provision of supplies or services and the conditions for selecting the Contractors who will supply or provide services to the Units from among the Contractors party to the framework agreement.
4. Procurement will be carried out successively, depending on the needs of the Units after the Unit has submitted an application for the contract, the Contractor has received a reply to the request for the order and the choice of the Contractor who will perform the order (implementing procedure).
5. Pursuant to Article 134(2)(7) of the PPL, the Contracting Authority shall indicate that it will conclude a framework agreement with a maximum of three Contractors (unless fewer Contractors submit bids that are not subject to rejection), who obtain the highest number of points in the evaluation of bids, based on the criteria set out in this SWZ, and whose bid price does not exceed the amount allocated for financing the framework agreement, with the proviso that the Ordering Party may increase this amount. If the balance of the points obtained is the same for several Contractors, the Contracting Authority shall conclude a framework agreement with all Contractors.
6. The list of products and the expected quantities of products and services specified in Annex 1A to SWZ — Price Form have been indicated in view to the preparation of the offer, on the basis of the planned purchases of Units. The Contracting Authority shall indicate that Units are entitled to request an order for any product present in the current Manufacturer's Price List within the product categories indicated in Annex 1A to SWZ or any type of service indicated in the Price Form. Contractors shall not be entitled to claim the execution of supplies and services in the quantities indicated. These quantities may change at the execution stage of orders by individual Units, subject to the maximum value of the framework contract not exceeding.
7. The subject of the executive agreements is the acquisition and delivery to the Units of all types of licenses for the Vmware Manufacturer's software indicated in the Manufacturer's Price List or equivalent software, together with technical support and the provision of expert support services of the Manufacturer and consulting support of the Contractor in the scope of the Manufacturer's software provided.
8. The subject of the contract carried out under the implementing agreements concluded under the framework agreement shall consist of the categories of products and services referred to in Annex No 1A to the SWZ — Price Form.
9. A detailed description of the subject matter of the contract is Annex 2 to the SWZ.
10. The list of Units which may award contracts or for which contracts may be awarded is Annex 8 to the SWZ.
In addition to Section VI.3) of the notice, point 13: Pursuant to Article 258(4) of the PPL, the contracting authority provides for the possibility of cancelling the procedure conducted for the conclusion of a framework agreement if fewer than two non-rejected tenders are submitted.
