The subject of the contract is a comprehensive supply - including the sale and provision of distribution services - of high-methane natural gas with the symbol E in the period from 01/01/2020. until 31.12.2020, with a total forecast volume of 21,519,969 kWh to 163 collection points.
A detailed list of collection points is attached as Annex 1 to the ToR. In order to determine the forecast gas consumption in kWh, a conversion factor of 11.3 has been adopted for an estimated quantity of 1,904,417 m3.
1. The subject of the order is a comprehensive supply - including the sale and provision of distribution services - high-methane natural gas with the symbol E in the period from 01/01/2020. until 31.12.2020, with a total forecast volume of 21,519,969 kWh to 163 collection points.
A detailed list of collection points is attached as Annex 1 to the ToR.
In order to determine the forecast gas consumption in kWh, a conversion factor of 11.3 was assumed for an estimated quantity of 1,904,417 m3.
2. The forecasted natural gas consumption indicated above is indicative and may differ from the amount of gas actually consumed during the contract period. The reduction or increase in the amount of gas does not entail any consequences for customers (gas recipients), except for the payment for the amount of gas actually taken and the transmission services in accordance with the Operator's Tariff.
3. Quality standards - The subject of the order is the supply of high-methane natural gas through the distribution network of Polska Spółka Gazownictwa sp. Z o.o. with defined quality standards together with the transmission service in accordance with applicable regulations.
Deliveries and distribution services provided on the basis of a comprehensive agreement will be performed on the terms specified in the provisions of the Act of 10 April 1997. Energy Law and implementing regulations to the Act and in accordance with the provisions of the DSO Tariff.
The quality parameters of gaseous fuels are regulated by the provisions of the Energy Law, executive acts, in particular the Regulation of the Minister of Economy of July 2, 2010. on the detailed conditions for the functioning of the gas system and the Regulation of the Minister of Energy of September 21, 2018. amending the regulation on the detailed conditions for the functioning of the gas system and Polish Standards.
4. Natural gas supplies will be carried out in the period from 01/01/2020. until December 31, 2020
5. Settlement periods result from the Tariff for the provision of distribution services, subject to the provisions contained in the relevant provisions of the contract (Annex 4 to the ToR)
6. Gaseous fuel will be delivered to gas collection points described in detail in Annex 1 to the ToR.
7. Details of the tariff group, estimated annual gas consumption by calendar month, contracted capacity in relation to individual collection points are described in Annex 1 to the ToR.
8. The Contractor, based on the Power of Attorney granted, will be obliged to:
1) submitting comprehensive contracts to the appropriate DSO on behalf of the contracting authority (recipients)
In order to carry out the seller switching procedure in accordance with applicable regulations,
2) representing the ordering parties (recipients) before the DSO in the process of changing the seller.
9. The contracting authority, together with the conclusion of the contract, shall grant the contractor the power of attorney to submit the statement required by the DSO regarding the total / partial termination of the currently applicable contracts.
10. Currently, gaseous fuel supplies are carried out by entities described in Annex 1 to the ToR - the description can be found under the lists of individual ordering points.
11. In Annex 1 to the ToR, the column "Change of seller" indicates in relation to which the change of seller will take place:
- for the first time - current contracts require termination - notice period - 1 month, termination will be submitted by the ordering parties (recipients) with effect as of December 31, 2019,
- once again - current contracts will expire (do not require notice) on the day preceding the planned date of commencement of gas supplies.
12. The condition for the commencement of deliveries within the deadlines is the effective expiry of the existing contracts and the effective conduct of the supplier switching procedure.
13. Declarations regarding the destination of the purchased gas for the purposes of excise duty will be forwarded to the contractor when signing the contracts.
