The subject of this contract is the execution of design works and then, on the basis of these works, construction works under the 'design - build' procurement procedure covered by the task 'Reconstruction and modernization of sewage treatment plants for the Koło agglomeration' according to the conditions described in the Functional Program developed by Tomasz Miazga Doradztwo, Services, Construction Supervision, ul. Puławska 228 lok. 67, 02-670 Warsaw, February 2020, and the conditions specified in volume III of this ToR. The contract implemented in connection with the contracting authority's implementation of the contract with the National Fund for Environmental Protection and Water Management in Warsaw, No. POIS.02.03.00-00-0189 / 16-00, under measure 2.3 water and wastewater management in agglomerations, the Operational Program Infrastructure and environment 2014-2020.
The scope of this contract provides for the modernization and reconstruction of an active sewage treatment plant facility for the Koło agglomeration, and on the basis of a power of attorney granted by the Employer to obtain an occupancy permit and transfer to the Employer for operation of the modernized and rebuilt sewage treatment plant for the Agglomeration Koło at ul. Energetyczna 11, together with the necessary accompanying works.
A detailed description of the new, two-draft, set up of new biological reactors, secondary settling tanks and the necessary accompanying tanks (primary sludge thickener and excessive sludge storage tank) planned for construction, together with a dewatering and chemical stabilization station; can be found in point 5.1 of the functional and utility program. All technological and servicing devices should be located in facilities or buildings adapted for this purpose. Due to the need to minimize the impact of the sewage treatment plant on the environment, including adverse climate changes, it is envisaged to cover and insulate the primary sludge thickener and the excess sludge storage tank, and ultimately to utilize the resulting sewage sludge to form a product. The sewage treatment plant should be adapted to current operational requirements. The target designed capacity of the sewage treatment plant will be:

A detailed description of the subject of the contract is presented in volume III of this ToR. The contractor is obliged to fulfill the contract on the terms and conditions described in the contract template constituting the Annex to the ToR (volume II).
Employer in accordance with art. 30 paragraph 4 of the Public Procurement Law allows in the case of solutions indicated by the authors of the Functional and Utility Program described by means of standards, approvals, technical assessments, technical specifications and reference systems, the use of equivalent solutions.
The Employer allows the use of equivalent solutions, provided that the proposed equivalent solutions (standards, technological solutions, devices, equipment or materials) will have all the parameters not worse than those specified in the Functional Program and volume III of this ToR. The Contractor, who refers to equivalent solutions described by the Employer, is obliged to demonstrate that the design solutions or construction works offered by him meet the requirements specified by the Employer. Possible verification of equivalence in the scope of the proposed solutions will be carried out by the authors of the Functional Program.
