Expansion or construction of an ultra-fast NGA network in accordance with the BayGibitR guideline in the development areas of the city of Osterhofen
a) Negotiated procedure
In order to select a network operator who can implement the construction and operation of an ultra-fast NGA network with a public subsidy, the contracting authority shall conduct an open, transparent and non-discriminatory selection procedure in accordance with No. 7 BayGibitR BayGibitR {Selection of the network operator in the profitability gap model} (available at www.schnelles-internet.bayern.de).
Network operators in this sense are the companies registered with the Federal Network Agency as the operator of public telecommunications networks within the meaning of Section 3 No. 27 of the Telecommunications Act (link:

The selection takes place in two stages by means of a negotiated procedure with an upstream public participation competition in accordance with Section 12 KonzVGV in conjunction with § 14 para. 2, para. 3 VgV. In the participation competition, the suitability (expertise, performance and reliability) of the applicants is checked at a first stage.
All participants admitted in this way are invited to submit an offer in a second stage and have the opportunity to submit an offer by the end of the offer period. On the basis of this offer, the client has the opportunity to conduct negotiations with the bidders. The client selects the most economical offer for the award on the basis of the evaluation criteria specified in point II.2.5 {award criteria}.

The system operator, which will be awarded wholly or in a lot after the completion of this negotiation procedure, shall be awarded a service concession to set up and operate a gigabite-capable NGA network for the designated development area in accordance with the attached address list.
The planned selection decision will initially be published on the central online portal www.schnelles-internet.bayern.de. The selected applicant receives advance information about the intended award. The award of the contract will only take place when the grant notice has been issued by the responsible district government and, if the cooperation agreement between the municipality and the network operator is submitted to the Federal Network Agency, its opinion is made or the deadline for comment has passed.

The broadband connections to be implemented for each batch are subject to the following performance requirements:
After installation or removal, the connections to be implemented must be bookable in accordance with the attached address list, products that reliably provide the following transfer rates:
- Transmission rates of at least 1 gb/s balanced for commercial connections (“target bandwidth commercial”) and
- Transmission rates of at least 200 Mbps symmetrical for private connections (“target bandwidth private”).
Insofar as the bidder offers the expansion and operation of the ultra-fast NGA network in FTTB/FTTH structure or comparable, the offer has the network expansion and operation
1 up to and including the network termination unit (house connection and connection device) of each advertised address (connection type "building connection"). For plots of land that have not yet been developed, the ultra-fast NGA network up to and including the property boundary must be taken into account.

The successful tenderer must comply with all relevant standards (including TKG) and other legally binding requirements relevant to the implementation of the measures, as well as obtain all necessary approvals, confirmation, etc. in good time and at his own expense.
