The subject of the contract is: Performing the function of the "Contract Engineer" as part of the investment: "Extension of DW 986 along with the construction of a viaduct in the city of Krakow". Ropczyce over the railway line 91"

The order in question is related to an investment that is planned to be co-financed from the program: Government Fund Polish Ład: Strategic Investment Program, in accordance with the initial promise No. 01/2021/6431/PolskiŁad.

Contractors are obliged to keep track of modifications of the above-mentioned proceedings.

As part of the service, the Contractor manages, performs control and investor supervision, and also cooperates with the Ordering Party's services in the field of reporting. Within the scope of this contract, the Contractor is to ensure the smooth implementation of the Contract

in the scope of preparation, design and implementation of construction works, efficient and timely receipt of documents and works as well as proper future functioning and service of works by the Ordering Party.

The order must be executed in accordance with the CONTRACTUAL CONDITIONS FOR ENGINEERING AND CONSTRUCTION WORKS DESIGNED BY THE ORDERING PARTY (according to the General Conditions, fourth English-Polish edition unchanged 2008 – translation of the first edition of 1999, also containing instructions for drawing up Special Conditions).

Under the Agreement, the Contractor shall perform the activities assigned to the Engineer in the above-mentioned Contract Conditions.

The contractor is obliged to have inspectors of industry supervision (m.in road, bridge, sanitary, electrical, teletechnical, nature) in accordance with the statement contained in the offer form.

A detailed description and method of execution of the contract is included in the Description of the Subject of the Contract (OPZ) constituting an Appendix to the Terms of Reference

The execution of the object of the order must be in accordance with the offer and the SWZ, in particular:

- Description of the Subject of the Order

- the proposed provisions of the public procurement agreement

- Price Form (FC)

Warranty period for defects

The Contract Engineer is responsible under the warranty:

• for the entire period of the Contractor's liability in this respect;

• without the right to additional remuneration.

The Contract Engineer's warranty is extended by the period of extension of the Contractor's warranty.
