1. The subject of the contract is the supply of electricity to the facilities of Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. Wołyńska 57, 22-100 Chełm in the period from 01.01.2024 to 31.12.2024. in a total estimated volume of 6,876,277 MWh over a period of 12 months. The list of facilities and collection points (PPE) is indicated No. 1a to the SWZ.

1. The subject of the contract is the supply of electricity to the facilities of Miejskie Przedsiębiorstwo Gospodarki Komunalnej Sp. z o.o. Wołyńska 57, 22-100 Chełm in the period from 01.01.2024. to 31.12.2024r. in a total estimated volume of 6,876,277 MWh over a period of 12 months. The list of facilities and collection points (PPE) is indicated No. 1a to the SWZ.

2. The distribution service for electricity consumption points indicated in item 1-40 of Annex 1a to the SWZ is provided on the basis of agreements concluded for an indefinite period with the Distribution System Operator (DSO) PGE S.A Zamość.

2.1. For electricity consumption points indicated in items 41-42 of Annex 1a to SWZ, the Ordering Party has comprehensive agreements valid until 31.12.2023. The Ordering Party declares that it will conclude a distribution agreement for an indefinite period with the relevant Distribution System Operator, i.e. PGE Dystrybucja S.A. Zamość branch (hereinafter referred to as DSO).

3. The Contractor undertakes to submit to the Distribution System Operator, on behalf of the Contracting Entity, a notification on the conclusion of an electricity sale agreement.

4. Current contracts of the Ordering Party for the purchase of energy end on 31.12.2023.

5. The actual amount of electricity depends on the actual needs of individual electricity consumption points of the Ordering Party.The Ordering Party guarantees energy consumption in the amount of 65% of the estimated amount indicated in point 1 of this Chapter.

6. The purchased electricity will not be intended for resale.

7. The contractor shall undertake to act as a responsible party for the commercial balancing of electricity sold under the contract and shall bear all related costs.

8. The Contractor, on behalf of the Contracting Entity, shall conclude a contract (POB) of the Trade Balancing Entity for balancing electricity from the source of 2x190 kW generation. (2 cogenerators).

9. The amount of electricity fed into the distribution network from two sources of co-generators is approximately 120 MWh/12 months. The Contractor undertakes to conclude an agreement in order to buy back electricity in accordance with the prices applicable on the balancing market on the day of introduction of the OSD PGE S.A. branch in Zamość to the DSO network. The list of cogenerators is indicated in Annex 2a to the SWZ.

10. The Contractor, on behalf of the Contracting Entity, shall conclude a contract (POB) Trade balancing entity for balancing electricity from a source of RES generation photovoltaics 4 pcs. x 49.5 kWp.

11. The amount of electricity fed into the distribution network from four photovoltaic sources of generation is approximately 9,8 MWh/12 months. The Contractor undertakes to conclude an agreement in order to buy back electricity in accordance with the prices applicable on the balancing market on the day of introduction of the OSD PGE S.A. branch in Zamość to the DSO network. The list of photovoltaic installations is indicated in Annex 2b to the SWZ.

12. The Contractor whose offer is selected as the most advantageous will be obliged to present model contracts indicated in point 9 and point 11 in this Chapter, for verification by the Contracting Authority, which will contain the essential terms of the contract indicated in Annex 10 to the SWZ.

13. The Contractor shall include in the price of individual tariff groups all components related to the purchase of electricity, including commercial balancing on the balancing market, as well as all fixed and variable components.

14. The Contractor shall complete all formalities related to the procedure applicable to the change of electricity supplier.

15. The Contractor shall be the excise duty payer for the consumed electricity.

16. The Ordering Party declares that it has a Certificate of Entry in the Register of Power Producers in a Small Installation No. MIOZE/URE00596/2018 and in accordance with the Act of 22.07.2010. amending the Act on Excise Duty, the obligation to pay excise duty for consumed electricity rests with the Contractor – Annex No. 11 to the SWZ.
