The subject of the contract are services in the field of forest management as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2022, item 672 – "Forest Act") covering works in the field of forest breeding and protection, fire protection, logging and skidding and tourist management, side use of the forest to be carried out in the area of the Olecko Forest District in 2023
1) The subject of the contract are services in the field of forest management as defined in Article 6(1)(1) of the Forest Act of 28 September 1991 (consolidated text: Journal of Laws of 2022, item 672 – "Forest Act") including works in the field of forest breeding and protection, fire protection, logging and skidding of wood and tourist management, side use of the forest to be carried out in the area of the Olecko Forest District in 2023.
2) The material scope of the contract includes the total quantities of works in the field of forest breeding and protection, fire protection, logging and harvesting of wood as well as tourist development, by-use of the forest, resulting from Annex No. 2 to the SWZ, which consists of
Appendix No. 2.1 – planned size of works;
Appendix No. 2.2 - detailed size of works by groups of activities, activities and location;
Appendix 2.3.1 – forestry characteristics in terms of logging;
Appendix 2.3.2 – assortment layout of timber harvesting in forestry;
Appendix 2.3.3 – summary of distances and conditions of wood skidding;
Appendix No. 2.3.4 – list of items with additional difficulties in obtaining and skidding;
Appendix 2.3.5 – list of items not available for machine acquisition;
Appendix 2.3.6 – information on the optimal technology of logging (potential);
Appendix No. 2.4.1 - information on the nature of forest care (zones for mowing weeds);
Appendix No. 2.4.2 - list of items not available for renewal made with the help of a planter.
(3) The material scopes set out in the annexes included in Annex 2 are estimates.
4) Quality standards relating to all essential features of the subject of the contract are specified in Annex 3 to the SWZ, which consists of:
Attachment No. 3.1. "Description of the standard of forestry work technology" adopted by Decision No. 34 of the Director General of the State Forests of 12 May 2022 on the introduction of the "Description of the standard of forestry work technology" in organizational units of the State Forests together with the changes introduced by amending decisions;
Appendix No. 3.2. Description of the standard of forestry works performance technology in the Regional Directorate of State Forests in Białystok adopted by Decision No. 11/2022 of the Director of the Regional Directorate of State Forests in Białystok of June 29, 2022 on the introduction of the Regional Description of the Standard for Forestry Work Technology.
A detailed description of the standard of technology for performing individual forest works (activities) specified in Annex 3.1 to the SWZ constitutes the basis for determining the quality requirements relating to the elements constituting the subject of the contract (Annex No. 2 to the SWZ). If the activity described in the above-mentioned annexes is not provided for in the description of the subject of the contract (Annex No. 2 to the SWZ), then in this respect the provisions of Annex No. 3.1. to the SWZ and in Annex 3.2. to the SWZ do not apply.
5) Descriptions of activity codes describing individual forest works (activities) included in the subject of the contract are described in Appendix No. 3 to the SWZ.
6) A description of the rules of the procedure for accepting forest works is included in Annex 3 to the SWZ.
3.4. The Contracting Authority shall not reserve the obligation for the Contractor to personally perform key tasks related to the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. If the contractor intends to perform the subject of the contract with the participation of subcontractors, the contractor is obliged to indicate in its tender the part of the contract (material scopes) that it intends to entrust to subcontractors, and to provide the names of any subcontractors, if they are already known. Such an indication should be placed on the Offer. If no subcontracting is indicated in the Tender, the Contractor will be able to introduce a subcontractor only under the conditions specified in the contract.
