Description:
Liquid fuel supply

The subject of the order is successive supplies of unleaded petrol Pb-95 and diesel fuel (summer, transitional and winter) under the terms set out in the draft contract.

1. The subject of the contract shall be successive supply of unleaded petrol Pb-95 and diesel fuel (summer, transient and winter) under the terms set out in the draft contract.

2. The estimated volume of demand during the term of the contract is:

1) unleaded petrol Pb-95 - 452 m3

2) Diesel fuel፦ 1.220 m3

3. The Contracting Party reserves the right to reduce or increase by a maximum of 25% of the quantities indicated in paragraph 2 depending on the needs of the Contracting Authority. If the order is reduced or increased by quantity as above, the parties will settle the supply according to the quantity of fuel actually supplied, and the Contractors, in addition to requesting payment of the price, have no other claims against the Ordering Party.

4. The aforementioned fuels must meet the quality requirements set out in:

1) The Fuel Quality Monitoring and Countering System Act of 25 August 2006 (Journal of Laws 2021, item 133, as amended);

2) Regulation of the Minister of Economy on quality requirements for liquid fuels of 9 October 2015 (Journal of Laws of 2015, item 1680 as amended) and the Regulation of the Minister of Climate of 22 April 2020 (Journal of Laws of 2020 item 727, as amended) amending Regulation on quality requirements for liquid fuels;

3) Quality standards: PN-EN 228 (for unleaded gasolines) and PN-EN 590 (for diesel fuel) or equivalent.

5. The Contractor will supply fuel to the Ordering Fuel Station, located in Sanok at 59 John Paul II Street by his own efforts and at his own expense.

6. The fuel ordered will be used by the Ordering Party both for own purposes and for further resale. The Contracting Authority holds a Concession for the Trading of Liquid Fuels issued by the President of the Energy Regulatory Authority effective until 31.12.2030.

7. Delivery delivery details:

1) the supply of fuel under contract will be carried out in parts corresponding to the current demand of the Contracting Authority;

2) the contractor will be obliged to supply fuels on the following day in relation to the date of placing the order, in quantities and assortment closely corresponding to the order placed by the Contracting Authority;

3) The Contractor is obliged to attach to each delivery a confirmed copy of the current quality certificate of the supplied fuel or a write-off of the fuel quality certificate issued by the accredited laboratory and the fuel issuance document from the fuel terminal;

4) The Contracting Authority requires that fuel supplies take place using autocysters equipped with a trigger with a counter of the fuel issued and a device carrying out a print containing at least information on the quantity of fuel spent and its temperature;

5) Fuel receptions will be held on working days from Monday to Friday between 6:00 and 19:00.

8. The Ordering Party reserves the right to collect samples of the supplied fuel. The fuel sample shall be collected each time in case of reasonable suspicion of non-compliance with the quality certificate presented /including clarity, suspensions, traces of water and other contamination/ and transmitted for examination in an independent laboratory in the manner and under the rules laid down in Regulation of the Minister of Economy of 1 September 2009 on the method of sampling of liquid fuels and liquid biofuels (Journal of Laws 2014, No. 147, item 1035), of which the Contractor shall be notified immediately. Where non-compliance is confirmed, the costs of such examination shall be borne by the Contractor.

9. Settlement of the quantities of fuels supplied will be carried out in accordance with PN-ISO 91-1:1999 or equivalent i.e. at a reference temperature +15°C using a legalised autocystern meter.
