ZP-2380-409/2023 Purchase, delivery and delivery of office supplies and supplies for the units of the Silesian garrison of the Police and the Central Bureau of Investigation, BSWP, CBZC

The subject of the contract is the purchase, delivery and delivery of office supplies and supplies for the units of the Silesian garrison of the Police and the Central Bureau of Investigation, BSWP and CBZC. A detailed description of the subject of the contract (minimum parameters, minimum warranty period and estimated quantities) can be found in Appendix 3 to the Terms of Use - price form with a description of the subject of the contract. The Contracting Authority may cancel the procurement procedure pursuant to Article 257 of the Act if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted. Settlements will be made on the basis of actually completed successive deliveries in accordance with the needs of the Ordering Party, according to the gross unit prices offered, subject to § 7 of the proposed provisions of the agreement. The value of the contract will amount to the amount that the Contracting Authority intends to allocate to finance the contract, specified before the opening of the bids.

The subject of the contract is the purchase, delivery and delivery of office supplies and supplies for the units of the Silesian garrison of the Police and the Central Bureau of Investigation, BSWP and CBZC. The Ordering Party does not agree to change the delivered assortment to a different one than the one indicated in Appendix No. 3 to the Terms of Use (price form), subject to the Ordering Party agreeing to change the delivered assortment to a different one than the one indicated in the price form according to Appendix No. 3 to the Terms of Reference in cases where the Contractor demonstrates that the offered assortment has been withdrawn from sale or its production has been discontinued, there is no access to it on the Polish market (confirmed by the manufacturer or sales representative on the Polish market) The Ordering Party allows for the possibility of offering and delivering a different assortment, provided that its requirements are met (which the Ordering Party has the right to check) before agreeing, and the price is not higher than the one offered in the price form, and the Contractor must obtain the Contracting Authority's consent to change the offered assortment. The Ordering Party requires that the entire assortment is brand new, free from technical and legal defects, admitted to the market, grade I, meets the quality and utility standards indicated by the Ordering Party in Appendix No. 3 to the Terms of Reference. The Contracting Authority requires the Contractor to indicate the manufacturer, name, symbol or other data enabling unambiguous identification of the offered product in Appendix No. 3 to the Terms of Reference, price form column 10. Failure to enter the manufacturer, name, symbol or other data enabling unambiguous identification of the offered assortment in the price form will result in the rejection of the offer pursuant to Article 226(1)(5) of the Act as inconsistent with the terms and conditions of the contract. The indicated assortment should meet all the requirements of the standards specified by the applicable law. The Contracting Authority requires the Contractor to grant a minimum warranty for the offered assortment covered by the subject of the contract, i.e. 12 months, 24 months and 36 months from the date of delivery in accordance with the requirements indicated in column 2 for each item in the price form – Appendix No. 3 to the Terms of Reference. The Contracting Authority requires that during the warranty period all costs related to warranty service, including transport, be borne by the Contractor. Settlements will be made on the basis of actually completed successive deliveries in accordance with the needs of the Ordering Party, according to the gross unit prices offered, subject to § 7 of the proposed provisions of the agreement. The value of the contract will amount to the amount that the Contracting Authority intends to allocate to finance the contract, specified before the opening of the bids. The gross price calculated according to Section XVII of the Terms of Use must be given in order to select the most advantageous offer. If the price of the most advantageous offer exceeds the amount that the Contracting Authority intended to allocate for the implementation, the Contracting Authority will decide whether to conclude the contract up to the amount of available funds, whether to increase the funds allocated for the implementation or to cancel the procedure. The Contracting Authority allows subcontractors. If the Contractor uses subcontractors, the Contracting Authority requires an indication of the parts of the contract that it intends to entrust to them. Provisions concerning subcontractors can be found in Section XI of the Terms of Use and in Appendix 2 to the Terms of Reference. The Contractor will ensure the protection of the transferred personal data in accordance with the Personal Data Protection Act and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR). The Contractor is obliged to submit a bid bond in the amount of PLN 35,000.00.
