Supply of electricity for the purposes of the Contracting Members of the Purchasing Group - Common Order

3) Ordering Party: Independent Public Clinical Hospital No. 4 in Lublin (also called SPSK4)
4) Ordering Party: Independent Public Clinical Hospital No. 1 in Lublin (also called SPSK1)
This procedure is conducted in the form of an open tender, referred to in Article 132 of the PPL Act, with a contract value equal to or exceeding the EU thresholds set out on the basis of the Article 3 of the PPL Act. The Contracting Authority provides for the application of the so-called reverse procedure referred to in Article 139(1) of the PPL Act
The subject of the contract is the supply of electricity for the needs of the Ordering Parties belonging to the purchasing group with the following forecasted (planned) active electricity consumption at the level of 28 408 548 kWh, including: UM - total forecasted (planned) active electricity consumption 8 212 515 kWh, USzD - total forecasted (planned) active electricity consumption 3 442 838 kWh, SPSK4 - total forecasted (planned) active electricity consumption 10 951 254 kWh, SPSK1- total forecasted (planned) active electricity consumption 5 801 941 kWh. Forecasted volume in kWh understood as estimated demand, having only an indicative nature and not constituting an obligation on the part of the Ordering Party (Ordering Parties) to purchase energy in the given amount. A detailed description of the subject of the contract is included in Annex No. 1 to the SWZ - "Description of the subject of the contract", which consists of 4 spreadsheets, including: sheet No. 1 UM, sheet No. 2 SPSK1, sheet No. 3 SPSK4, sheet No. 4 USzD.The Ordering Party informs that the process of changing the seller takes place for all collection points once again. The Ordering Parties belonging to the Purchasing Group have concluded both separate sales agreements and electricity distribution services. Detailed data is included in Annex 1 to the SWZ – "Description of the subject of the contract". The Contracting Authority shall authorize the Contractor to carry out the procedure of changing the seller and submit on behalf of the Contracting entity notifications of the sales contract on the basis of appropriate, separately signed powers of attorney on the part of each Contracting entity belonging to the Purchasing Group, for this purpose, the Contracting entity undertakes to provide the Contractor with the necessary data and documents. The supply of electricity will take place under the conditions specified in the Act of 10 April 1997. Energy Law, in accordance with the applicable regulations to this Act, the Civil Code, the rules set out in concessions, the provisions of this contract and based on the Act of 11 September 2019. Public procurement law. The contract in question does not cover the distribution of electricity, connection, metering and energy quality, which are included in the scope of a separate agreement for the provision of distribution services concluded by the Ordering Party with the Distribution Network Operator.The Ordering Party UM informs that it has a contract for the provision of distribution services with the relevant DSO, concluded for an indefinite period for each of the PPEs, and that it does not have a comprehensive agreement. The Ordering Party of the USzD informs that it has a distribution service agreement with the relevant DSO, concluded for an indefinite period for each of the PPEs, and that it does not have a comprehensive agreement. The SPSK4 Ordering Party informs that it has a distribution service agreement with the relevant DSO, concluded for an indefinite period for each of the PPEs, and that it does not have a comprehensive agreement. The SPSK1 Ordering Party informs that it has a distribution service agreement with the relevant DSO concluded for an indefinite period for each PPE, it does not have a comprehensive agreement. Individual Ordering Parties have legal titles to facilities covered by the supply of electricity. Measurement and settlement systems for consumption points of facilities covered by the supply of electricity are adapted to the TPA principle. The Contractor is obliged to perform the contract on the terms and conditions described in the draft provisions of the contract constituting Annex 4 to the SWZ. As a result of this procedure, 4 separate agreements will be concluded with each Ordering Party belonging to the Purchasing Group
