The scope of construction works envisaged for implementation in the framework of the expansion of provincial road No 486 shall include:

— extension of the provincial road number 486,

— reconstruction of existing intersections,

— demolition and construction of pavements,

— demolition and construction and reconstruction of descents,

- lighting construction,

— construction of stormwater drains,

— reconstruction of sanitary sewerage,

— reconstruction of the water supply, electricity, telecommunications network.

1. Pursuant to the regulations of Art.121 Pzp, the Contracting Authority reserves the obligation to personally perform key tasks concerning: the performance of bituminous layers of the roadway structure (basic substructure layer and binding and abrasive layer). This requirement does not apply to the production and transport of mineral-bituminous mixture. With regard to key tasks reserved for personal performance by the Contractor, the Contractor shall not rely on the capacity of the resource sharing entity, under the principles laid down in Article 118 (1) of the Pzp Act, in order to demonstrate the fulfilment of the relevant conditions of participation in the proceedings.

2. The Contracting Authority shall apply the procedure referred to in Article 139 (1) of the Pzp Act (i.e. the so-called reverse procedure). In the first instance, the Contracting Authority shall examine and evaluate the tenders and then make the qualification of the Contractor whose offer has been highest assessed in the absence of grounds for exclusion and fulfilment of the conditions of participation in the proceedings.

3. In accordance with Article 310 (1), the Contracting Authority provides for the possibility of annulment of the procedure in question if the funds which the Contracting Party intended to allocate to the financing of all or part of the contract have not been granted to it.

4. The Awarding Entity does not provide for an electronic auction.

5. The Contracting Authority shall not conduct proceedings to conclude a framework agreement.

6. The Contracting Authority does not provide for the selection of the most advantageous offer with the possibility

7. The Contractor is obliged to contribute a defect of PLN 86 800,00.

8. Pursuant to Art.95 Pzp, the Ordering Party requires that the Contractor/Subcontractor employ persons pursuant to the contract of employment during the execution of the contract, if the performance of these activities consists in the performance of the work in the manner laid down in Article 22 (1) of the Act of 26 June 1974. — The Labour Code, i.e. employed persons pursuant to an employment contract during the execution of the contract, covering in particular those listed in point II.1.4, with the exception of persons performing independent technical functions in construction and persons carrying out activities related to carrying out surveying work, design work, including environmental studies, measurement works in the field of power networks and lighting equipment.

9. The Contracting Authority provides for the award, within 3 years from the date of the award of the basic contract, to the existing Contractor of services or works, of a contract consisting in the repetition of similar services or works in accordance with the subject of the basic contract, up to the amount of 2 170 858,69 PLN net.

10. The Contractor shall be bound by the offer for a period of 90 days.

11. The financial limit for 2021 is fixed at the amount of PLN 1 250 000,00 gross.
