Conclusion of five (5) framework agreements for the rental of up to 500 freight wagons (4-axle flat wagons for the transport of building materials – type Res and/or Rens with wooden and / or steel floor)

Awarding of framework contracts

The award of five (5) economically most advantageous framework contracts is envisaged.

With these five (5) framework agreements, the client intends to lease up to 500 freight wagons (250 freight wagons via the first (1st) call(s)).

Only one (1) framework agreement may be awarded to each bidder.

Only those five (5) bidders who, on the basis of the evaluation criteria, have selected the first five (5) economically most advantageous bids (places 1 to 5; "ranked" / "ranking").

If fewer than five (5) bidders submit a valid bid to conclude a framework agreement, the correspondingly smaller number of framework agreements will be awarded in accordance with the procedure described above and below in section 15.1.1.

The five (5) most economically advantageous bids will be awarded a framework contract. The awarded bids are "ranked" as follows: To determine the ranking (1st to 5th place), the evaluation matrix (Appendix C6 "Evaluation scheme") is used. The sum of the contract conditions and the prices are included in the evaluation.

Awarding of call-offs

Among these five (5) economically most advantageous framework contract partners awarded, the client shall award one or more first (1st) call(s) and each possible subsequent call(s) as follows: The client will inquire about the specific need for a call-off from all of the economically most advantageous framework contract partners awarded only with regard to the availability of the freight wagons (at the first (1st) call-off or at the first (1st) call-off, i.e. the rental of up to 250 available freight wagons). The framework contract partner who is in first place in the ranking of the economically most advantageous framework contracts awarded is awarded the contract for the quantity of freight wagons available to it. In the event of a remaining difference between the number of freight wagons to be leased by the first-placed framework contract partner and the existing call-off requirement (i.e. up to 250 freight wagons for the first (1st) call-off or for the first (1st) call-offs), the framework contract partner second-placed in the ranking of the awarded framework contracts will then receive the surcharge for the quantity of freight wagons to be leased by him until the total demand of the respective call-off is covered (at the first (1st) call-off or, in the case of the first (1st) call-offs, i.e. up to 250 freight wagons).
